Browse Forums Building A New House 1 Apr 04, 2011 9:03 pm Hi, Currently I own a block of land, I've owned this block of land for about 6 months now, and about 2 months ago construction started on the block next door. Temporary fencing was erected well over the boundary, and they have been driving over my property and making little holes in the ground. I believe they will be on there side of the property once they remove the temporary fencing, however I'm not sure how to check, I should know in the next month or two as they already have a slab & frame. However, recently they have started dumping rubbish on my property such as broken tiles. The builder is Porter Davis. What rights do I have ? And how do I complain? I just sent an email to Porter Davis. And I will try to call the site supervisor tomorrow in regard to the rubbish. I haven't started building yet but I do have to maintain the lawn by council rules, and everytime I go I find new bricks/tiles/wood on my land. They must contain rubbish on their own block. You could even call the council as the builder could possibly be in breach of the building licence (some state that rubbish must be contained within the block), and if not they could perhaps be done for littering? Be aware that if you start building and you still have the rubbish on your site, your builder will either require you to remove it, or they will charge you more if they have to remove it. Regarding whether they have built in the correct position or put fences in the correct position, this could be checked by having a surveyor do a re-peg and check of dimensions. If you begin building soon, this is part of the building process. I'm not sure if every state in Aus is the same, but in general if they are encroaching on your land the neighbour technically will have to give you back your land as they have not been living there for long enough to claim it as their own, however it is a touchy subject. Thanks. The temporary fencing is made *around* there block with a good 1/2-1metre away from the edges of it, which is on my land. There is a small pole at the back of the land with a flag and a line on the driveway advising where there land stops and myn begins so I think they're aware of which is my land and which is there's. It is only there garage which is built right near the borderline, although I believe that is normal. I'll just have to be very careful that they don't attempt to erect a permanent fence over my land. I have not received a call back from anyone at Porter Davis, although its only been 48 hours. I'm sure they'd reply if it were a sale I've attempted to call the number listed on the board at the front of the property, I have either noted the number incorrectly or it appears to be fake. I wouldn't worry too much about temporary fencing. I had the same situation with a builder of the lot besides mine. Once my builder commenced work the fence was moved back to it's approximate correct position. Thanks, I'm only nervous that they will make a permanent fence and one day I'll arrive there and have to request it to be torn down or prepare for an argument Re: Pre-build rubbish been dumped by another builder (& fenc 10Apr 09, 2011 8:30 am I wouldn't worry overly much about the temp fencing, for the most part the company who put it up just take an educated guess, and just put it up to suit the panels, so its never going to exactly follow the exact boundaries. Secondly nearly all the tradies will open, close and move the fence to make their life easier, if you're building at the same time it tends to become more of an issue. The main thing to keep an eye on is that they aren't dumping waste on your land, also seeing as we're coming into the wetter months also make sure if the fence is on your side of the boundary they leaving bricks/tiles etc on the boundary or you land as they'll sink in and get missed by the site clean. We had a similar situation with the PD being built beside us, we finished earlier than them whilst we had some issues getting it removed, after I spoke with Jess on behalf of Team PD they got it sorted within a couple of days. Not sure about the rubbish, they might have removed a little, there is quite a bit of concrete there so I'll speak to my builder about this on Monday and ask if this will cost money to remove. They've made a bunch of new holes by driving machinery over my block AGAIN. The cage is constantly over flowing and a huge amount of rubbish has been blowing up and down the road. Porter Davies is the only builder with a constantly over flowing cage. This has been going on for sometime now. I can post pictures if you like. ive seen cows at the bottom of the estate eating huge amounts of plastic from this rubbish. im really concerned and it looks terrible.
