What happens when they wont pay or wont agree? The fence we are installing is in a development area, so it all has to be the same kind, so no room for other options! They had there house built at least 6-9months before we started to build, so they have known about it for a long time. We have given them notices, told them in person etc. Any advice would be great thank you. you've got two options, refer to the local council and see if they have options. Or discuss with your fencer, an order to fence - this might be a council thing as well. I will try the council. I wish it was going to be that easy with them. The owners got very worked up (yelling and swearing) about us giving them notice for a fence - even though they knew it was coming since mid last year. Most states have an act with strict procedures you must follow that when followed hold your neighbour legally liable. In SA if no agreement can be reached then you can seek mediation or apply to the Magistrates Court for a determination. We also had to install a retaining wall and it was going to cost a large sum of money but we could do it ourselves and tired to do the 'good neighbour thing' and paid half. All the fences have to be the same. Yeah, if it ends up going to court, it could be awkward with them. It is silly also, because when you build a house in an estate you know that you have to pay for fencing. If they think the quote is too expensive, they could source their own quote. But the houses that are lower, have had to pay for the wall. They have cut their block out more. The neighbours have a retaining wall to do at the back as well (about 3 concrete sleepers) because they have cut out their block more than the people behind.
