Browse Forums Building A New House 1 Mar 21, 2011 5:18 pm So the story is our builder received the letter to commence on the 1/02. They have 28 days to get on site and still no sign of them. They were meant to start last Thursday - i went to site to have a look , all they had done was put there sign on the fence. Friday the loo was delivered. I called the supervisor who spun some story that the excavator has broken down and trying to get parts is pretty much not an option and they have to try and get it repaired and he may be there on Monday to start excavations. So we spent all weekend out at our property doing gardening, so i called today and 'No, we wont be there today, there was way to much rain over the weekend' i said 'what rain, we were there all weekend working and had not a drop of rain'. He laughed at me I called The state GM on friday and again today and wont call me back. So my main question is so there is a 28 day commencement date - we are now up to day 53. When does the 23week build start? Who is responsible for the loss of time? on paper they are already 4 weeks behind - thats $1600 in rent we have to pay. Am i just being impatient? i dont really want to complain in fear ill be put to the bottom of the pile, but come on we paid the deposit in April last yr. One thing you need to look at is is there a liquidated damages clause in the contract and how much. Unless there is a realistic amount there is little pressure on the builder to meet the timescale. One thing I have always done in the past for situations like this is write a formal letter detailing my concerns. Most builders find this harder to deal with than fobbing you off with phone calls because they know letters can be produced if a contractual dispute arises.
