Browse Forums Building A New House 1 Dec 26, 2007 8:04 pm Hi all, just need some opinions. We visited our house and noticed that the bathroom lights were incorrect. Ages ago for some reason they changed the contract drawing from the tender lighting plan and we didnt notice to well later on. What we wanted was 3 downlights however they had on the drawing as 3 downlights and a batten light in the middle. We called them and told them that is not what we asked for and they were happy to do a post contract variation which was fine. We got the contract variation and signed it. However have since read the post contract variation again since we noticed that the lights were wrong and it said that we wanted to remove 1 downlight and move the batten light to where one of the downlights were. This is so incorrect. Have since checked our online corrospondance. PD 24/7 and there is an e-mail from us clearly stating what we wanted : Remove the batton light and change the downlight from an additional light to an upgrade (from batton) and they have posted there reply saying that is what will be happening and they would send it through to us a contract variation and we got it and signed, however we did not read it properly. Handover is not until 1st Feb, does anyone think we have a leg to stand on with getting this fixed?

You still want the house to look nice so can they please change it again to read as per your e-mail..... PD cannot be so bad as to say no.....it's just a miscommunication...and it can be easily fixed - i would think anyway. ![]() ![]() Post Contract Variation 3Dec 27, 2007 9:11 am Unfortunately you signed the variation. Harsh, perhaps but that is what they will most likely say. This happened to us with our facia/guttering. Clearly written in an email but wrong on the variation.
We were a couple of days out from heading on an overseas trip and my mum was extremely ill in hospital. I just signed the variation and sent it back. When we returned from our trip and found the wrong colour had been painted and manager (whom we were dealing with because we had so many issues) told us it was too bad. We certainly learnt our lesson about signing things before reading them. Like your contract, a Variation to contract overrides all previous documentation and requests either verbal or written, as far as I am aware. Re: Post Contract Variations - Help please 4Dec 27, 2007 12:17 pm From reading your post it sounds like the electrical is fitted off, the sparkies will be back to install your appliances at handover, your best bet might be to ring the sparky and see if you can cut a deal with them to make the changes whilst installing the appliances. I'm sure there will be plenty of other little things that you will want touched up or fixed in your pre hand over inspection.
The builder I used had no problems fixing anything that we noticed or anything that was done incorrectly. In fact I think he found more imperfections the than we did. Be upfront about your problem, show them the 2 email's requesting how you wanted it and it should be fine. Hi all, I was wondering if we can be charged anything at the end of the build extra?
