Browse Forums Building A New House 1 Mar 08, 2011 8:01 pm Hi, Just wanted to see if anyone has been succesful or if they have applied to have there NSW Home Builders Bonus (Waiving of Stamp Duty) extended by the OSR on land their purchase... Bascially we have been dealing with our builder for almost a year and our plans were already to go and submitted to council on registration and settlement which was Oct last year and part of the HBB was that foundations had to be laid within 6 months or 26 weeks of settlement which for us is at the end of the month and yep our builder has still not commenced we have signed all the contracts and they have exchanged, our commencement within 28 days is actually up tomorrow and still have no dates for a start despite my daily followups with our builder and now I am really worried and think we may not meet our deadline of 25/3 to have our slab complete as I need to take into account weather....... I did call the OSR about a extention and was told to write a letter to the commissioner requesting a extention and they would advise within 2 weeks whether approved or not.... Wondering if anyone is experiencing this also and if been sucessful with the OSR?? We had to apply for an extension to FHOG because our land settlement was delayed and site start didn't occur within 6 months of signing the contract. We needed a letter from the builder outlining why they were delayed, and noting key dates eg contract signing date, land settlement date, council approval date and anticipated site start. We had no trouble getting an extension. As with Carlswil my land settlement was delayed significantly (the approval of the subdivision took forever) thus I had to seek an extension. You need to write a letter to the OSR outlining the reason for the delay (include your FHOG application number which your bank should have as they apply for the grant on your behalf); basically you need to say that the delay has been caused by issues beyond your control. In your case I reckon you would absolutely need a letter from your builder saying that they have caused the delays and also stating when they will be likely to complete the slab. I obtained a letter from my developer to the effect that the delays were their fault. Do a quick search on here for FHOG extension and you should even find some precedent letters. We settled on our land in September and the quoting process from the builder started just before then. We only got to council 2 weeks ago so I reckon we are at least 2 months off having a slab down (our deadline is 22 March). I wrote a letter outlining the actual dates the builder has done anything in terms of providing us with a quote and drafting the plans to show it is their fault we have no slab. While the OSR cannot give advice over the phone, i was told that it is possible to get an extension if the reason for not building was circumstances beyond your control. She said that delays from the builder or waiting for council approval both fall within this definition. Will come back in here once I get a response. Tell you what, my builder won't know what hit them if we get declined. Is that another 6 months? Is that what you asked for or is that what they granted? I think you should send off the letter now. The advice I was given from OSR is that it takes 2 weeks for a decision to be made so the application should be filed 2 weeks before the 6 month deadline.
