Browse Forums Building A New House 1 Mar 07, 2011 10:46 am Hi, I'm building my first home with National Builders and through their sub builder - Infinity Builders...signed the contract in Jul 2009 - the construction started in Jun 2010 and now the construction is almost (well almost) over....the builder told me that they are trying to get the building permit now...they got the first inspection from the building inspector done on 22 Feb and said that the FINAL inspection was done on 01st Mar..Can anyone help me to know how long does it take to get the occupancy permit after FINAL inspection by the surveyor. After the occupancy permit is issued, the builder has said that they will arrange a preliminary inspection with us...I'm wondering if I'll be lucky enough to move into the house by end of March...you know it's been a long wait...Any advise will be appreciated... I even directly called the building surveyor company but they refused to answer and asked me to go back to the builder. Re: How long to get occupancy permit 6Mar 07, 2011 1:34 pm As the building permit was issued to the builder, the surveyor can't really tell you anything. You will have to ask the builder. It really only takes a signature to issue the occupancy permit. It seems that the surveyor wants them to fix a few more things. I wonder what was done in the 1st Inspection and why there are still things to be fixed after the FINAL inspection was done. Builder has not told me what things need to be fixed and when they will be fixed....so another unknown wait (as it has happened all along)...Don't know what to do.................. Re: How long to get occupancy permit 8Mar 08, 2011 7:34 am Can you clarify what you mean by 1st and Final inspection? Half my family are building surveyors / inspectors, so I have picked up a few things over time. There are several inspections over the construction of a house (varies depending on the construction). eg. Footing, sub frame, frame, final etc. The Final inspection is done when the house is completed, but its not necesserally the last inspection. The final inspection may need to be done 2,3,4, 5+ times before the builder gets it right. The builder may have not fixed issues appropriately, or the inspector (may be a different inspector each time) picks up new things that need fixing. Be happy that the inspector is finding these things now, rather than you finding them in a few years when they become a real problem. SOme inspectors live in the builders pocket and just sign off on work, so this is actually a good sign for you. Even if it takes a few more days. Its worth it. Then he did second inspection (Final inspection)to check whether the builder has fixed all the issues from the 1st inspection and also identified a few more issues. They have now issued me the occupancy certificate However, I have another question, because the builder did not finish the construction on time, he is paying me liquidated damages which they have calculated till the date when OC was issued. Shouldn't this be calculated for delays till they hand me over the house? I did the preliminary inspection today and there are a lot of minor faults which may take 2 more weeks to fix before they hand me over the house. It follows the standard HIA Victoria contract and refers to "Agreed damages for late completion of building works - clause 40" and "Agreed damages for delays clause 34.1" - For both these items it is $200 per week. They wont actually pay you. they will just take it off the final invoice.
