Browse Forums Building A New House 1 Feb 25, 2011 10:29 pm Hi all, We have a site on which we are to build soon. I visit the site everyday and to my shock when I went there today I saw the neighbors builder had dumped their site scrap soil on my site. I called the supervisor and she assured me it will be removed on Tuesday at the latest. However I did tell her I was disappointed that she didn't call to ask me first. I really wouldn't mind if they had asked me first. Then I saw that their trucks/earth moving equipment has broken the pavement/sidewalk in front of our house. What can/should I do at this stage? I have taken pictures of everything. Should I complain to the council in addition to informing my neighbors builder? What are my legal options at this stage? Technically the pavement is the concern of the council or do I have some responsibility? Should I take any steps to ensure that my site is returned to its original state? Has anyone else experienced this before ? I'm having sleepless nights as is your help is greatly appreciated. My builder doesn't seem to help or care. I cant blame them either its not their fault. Their builder should have paid the council builders asset protection which should cover them to have the council fix it, make sure the council realises it wasn't your builder that did it as your builder won't get their asset protection back which may in turn cost you money. We contacted their builder and spoke to their site supervisor. We were really surprised that he admitted to everything and promised to fix our site up within a week. They did remove everything except for half a pallet of bricks and a bit of white gravel. We also contacted the council numerous times about the poor condition of the pavers around our property as we were afraid someone could trip and hurt themselves and did not want to be liable for it. 6 months later a new guy got hired at the council and arranged a meeting at our site that included us the neighbors site supervisor, and other ppl regarding who would be responsible. Lucky for us we had very good photos That proved it was the neighbors builder and not ours and within the week the removed the whole section of paving and replaced it with road base until our build is complete. The council and their builder are going halves in the cost. overall what we found out from the meeting is that if any one were to have got injured their builder would be liable not the council as the did not show due care in protecting council property and in future if our builder where to damage council property we as the land owner would have to pay for any repairs. So in short take lots of photos contact ur neighbors ss ask the to return ur site as it was originally send emails to the company involved as well so they are aware of any poor contractors as their actions reflect on their business and need to know. And inform the council and estate ppl ,and try to organize a meeting to resolve it. Hopefully it will be resolved quicker than ours did. I then called the council and reported the matter who in turn asked me to ask my builder to contact them.
