They put in the worlds ugliest window in our family area, it looks like a sliding door...it's hideous, anyway the framing in the middle of the window (its a fixed window 1800x1800 that way I didn't have to security grill it and can save on pool fencing as well) is very badly scratched, so much so that if I were to hang a curtain or blind it would catch and tear, instead of being white it has scratch marks doug well into the frame. This would be the result of leaving the window on the block next door for weeks before moving onto our site then leaving it lay around outside for weeks again. I have asked for it to be repaired/replaced - my preference is for it to be GONE!!! and replaced with what I wanted in the first place - I've told them I would have paid for the single panel of glass but they didn't even give me the option, surely they can do it now that the window that is in there is no good. There are also another 3 windows that are scratched but no where near the extent of the first one. I would replace the first one... but 1800 x 1800 in one piece is expensive so expect a mullion (centre vertical divider). There is a Standards and Tolerances guide which gives guidelines as to what is a defect or not (do a search for the doc/link). If your window is that badly scratched it will need to be replaced. You may not however have the right to get the type of window changed without paying a variation fee - it is something that you'd need to negotiate with your builder. You would have received plans and elevations and that's when you need to make sure everything is as you were wanting..... So when I saw what they came up with I was horrified. But I'll live with it, if the house ever gets finished and yeah I just meant replace like for like if they were going to change it, or if it was getting changed let me pay the difference for the one I wanted. Ed - cheers, I guessed as much "that is was the lowest cost window" it is one ugly window, maybe wouldn't be so bad if it wasn't so prominent, but hey $h!t happens. I met with the site supervisor and he told me they buff it out and repaint it. That's ok as long as it doesn't look cr@p, so we'll see what happens. Thank you both for your comments, much appreciated. cheers our dream home in the hands of a nightmare builder Cheers for your help Re: Rights regarding damaged windows 9Jan 28, 2011 10:22 am your builder will fix it and get it back in tip top condition, unfortunately they are under no obligation to "upgrade" to a single panel fixed or even a double panel fixed, you will be stuck with what sounds like a 4 panel fixed window unless you get an agreement and pay the difference. ( which will end up being for the full price of a new window) as the old one will become a throwawy item which you will unfortunately still pay for. Even still, it may end up being a "special" window which will take more labour to produce - window companies charge like wounded bulls for these types of windows. make sure you decide on an outcome and commit to it..when its in- its in for good, or expect even more money and a messy job to change it again. I wasn't after a freebie just for the window to be fixed and if they had to replace it I would have gladly paid the difference to get the window I requested in the first place. Their idea of a fixed panel of glass instead of a window differed from mine, however with no drawings to agree on it was my loss and I'll live with it - that quest to get the window I wanted originally was lost long ago. We are up to site supervisor number 4, electrician number 2 & carpenter number 4 ......and with a build that is now 68days over due and still having at least 3 wks before handover any faith I had in this build is looooong gone. At least one day when we do get to move in, it will be BEAUTIFUL!!!!
