Browse Forums Building A New House 1 Jan 19, 2011 9:17 am Hi. We are currently building through M and as our land has been delayed by 4 months we are having to pay them $1000 a month for price extension, can you please advise me if this is normal in most contracts and if there is any way to get out of this?? We did sign the contract however we didnt think it would take extract 4 months as the sales lady gave us much confidence in when the land would be ready Re: Building with M3tric0n 2Jan 19, 2011 1:56 pm Did M sell the land to you as well? If they did, then I would be pushing to have the extension fee waived. It's the job of the sales lady to give you confidence, even if she can't back it up. The rule is "If it isn't in writing, along with a specific penalty for it not getting done (such as the developer paying YOU $1000 for each month of delay), then it was never promised". It was in our contract because we didnt think the land would be delayed by this much and didnt think we could get out of it, things are such a mess atm. I just wanted to know if it was a normal thing with House and Land packages?!? Re: Building with M3tric0n 5Jan 19, 2011 3:17 pm Charlene We are building with Simonds, and we copped the same thing in our contract, we were delayed almost 6 months Are you serious?? 6months wow, Its so unfair these companys make enough money then to take more of us So is it contracted that every month they delay you pay a price extension per month?? Re: Building with M3tric0n 7May 02, 2011 9:30 pm same thing here..normally its a increase of 0.5% of total cost of house...we had a delay of 4 months but was only charged $3000..instead of $6,000..it will all be stated in the contract you read and signed. I have built with Simonds as well and our land was delayed by 2 months and were supposed to pay extra $2000. However, after handover, it seems that they have forgotten to include that $2000 delay fees. So I kept quiet and didnt mention it at all to Simonds. You might try to same thing? I’m curious about how you went with this. We are planning a KDRB and considering Plantation Homes as a builder.
