Browse Forums Building A New House 1 Jan 07, 2011 9:38 am Hi all, with our house 8 weeks behind schedule (currently at lock up, was meant to be finished Dec 15 2010), my DW and I were wandering how common this is with fellow H1 and are we mostly in the same boat. * Are we there yet ? It was an 8 1/2 month build (of a 9 month contract). It could have easily been finished in 5-6 months, however our build dragged out the last 12 weeks. I think from memory they allowed 26 weeks, but from slab pour to move in was only 11 weeks .. Ít's been a combination of issues, not always únder the builder's control, unfortunately. It would be nice to be able to clearly point the finger at someone. In our contract there is a clause that states if the builder does not reach "practical completion" within the contract period, then they have to pay liquidated damages. We hadn't worried about pursuing this action as it always seemed to be "almost finished", plus there is a discrepancy as to when the actual contract commenced. We thought it was October, 2009, they said December, 2009, so we thought we would at least wait until there dates had expired before working out what to do... Has anyone been down this path and charged their builder for damages as per contract? And if so, how was it received by the builder? (I'm assuming not that well). If your contract allows for liquidated damages, it should be subtracted from what you owe in the final progress payment - although many builders handle it as a refund after handover. It isn't something that you receive on a weekly basis once you pass the end date of the contract, as many people seem to expect. Our build ran 16 weeks over the period allowed in our contract, and our builder simply calculated the amount they owed (correctly, I might add ) and told us at our handover meeting how much it would be. They then sent us a cheque, which we received within a week of handover. Just ask your customer service rep how it works with your builder - it shouldn't be an issue. We did the painting ourselves and it took a little while to finish (we're still painting the trims in some rooms!), however, whenever they asked us to have a certain area ready, it always was. I was told by a lawyer that unless they actually put in an extension for time, they cannot argue this point against paying the damages?? Could have been done at least 4 weeks sooner as no work was carried out for 29 days (yep I was a daily visitor to my site) after the roof tiles went on. SS told us a late Oct / early Nov handover but it didn't actually occur until 8th Dec. For people about to sign a new contract, it may be worth rethinking contracts penalties (although they don't nomrally negotiate to much here), organising rentals and general sanity for expectation of completition. * Are we there yet ? Site scrape was 19/5/10. Probably looking at March 2011 now...who knows??? It took 12 months just to get the pad down. Jan 2011 and we have just made the Roof Cover progress payment. By handover, we might be 7 months behind if we are lucky! Happy about that! Why are peoples homes being delayed? There must be reasons given? Lack of tradies? Lack of building Materials? Care factor? etc Might help people work out which builders have over extended themselves before they fall into the same trap?
