Browse Forums Building A New House 1 Dec 17, 2010 8:26 pm Hey guys, Just a question on a quote we've gotten (for a cooling quote); Our original quote placed our system @ ~$15000. However, upon further inspection I realised they missed out on some ducts, called them up, and they realised had to re-do the quote. I got the quote back today, with an additional note that they had 'incorrectly costed the first quote', and so the system would be priced @ ~$16200, even without any changes. Do I have a case to argue? Note that they have placed the re-done quote at $16600, equating to a $400 increase to account for the 2 extra ducting points. Thanks for your time all! Bashworth, thanks for your input. My real question though, is if I can argue that the company should honour the original $15000 quote (+$400 for the extra ducts), rather than blaming it on calculation errors and charging me $1200 extra for it. Re: Honouring a quote? 4Dec 17, 2010 10:50 pm you can argue it, but there is no legal requirement for the other party to agree to your arguement But it would be a good negotiation 'if you can do it for $XX,XXX - here is the deposit, I am ready to go'. At the moment there is no contract, you are both free to do whatever you wish Re: Honouring a quote? 5Dec 18, 2010 8:18 pm Unfortunately they would be under no obligation to honour it and there's not much point in taking it further to fight it as you would have no leg to stand on as the initial quote is legally binding. They may honour it as an act of goodwill or if you did something like what Lunchtime suggested or paid cash, but they don't have to. viewtopic.php?f=31&t=37229 - our Iris 4! Re: Honouring a quote? 6Dec 18, 2010 8:41 pm you can't make them stick to the original quote but sometimes businesses will do that as a sign of goodwill, but you they don't have to. You could suggest it to them that would be the honourable thing to do and see if it works. Re: Honouring a quote? 7Dec 18, 2010 9:43 pm Does the quote say how long it is valid for? If you are within that period, I would have thought that they would honour it. contract signed: Nov 09 Released to Construction: 23 Jul 10 Slab poured: 9 Aug 10 Frame completed: 30 Aug 10 Windows & Gutters: 7 Sep 10 Bricks: 15 - 23 Sep 10 Roof: 24 Sep 10 Gyprock: 20 Oct 10 Lockup: 25 Oct 10 Kitchen: 27 Oct 10 Tiling: 6 - 9 Nov 10 Painting: 17 Nov 10 Carpet: 30 Nov 10 PCI: 15 Dec 10 Handover: 17 Dec 10 https://forum.homeone.com.au/viewtopic.php?f=31&t=35943 Re: Honouring a quote? 8Dec 19, 2010 12:56 am The initial quote states that it is valid for 7 days - dated 15/12. It's a tad frustrating though - there's the scenario of "what if I signed the $15k and then later on you guys realised you missed out 2 ducts" - which I would assume would technically be my responsibility because then I wouldn't have checked over the quote properly before I signed it. Now that I've checked over it and found an error, I'm being charge $1200 for it.
