This is in their rights. I know it is frustrating but that particular term of the contract is to protect M from things that out of *their* control. It does not matter whether it is under your control or not. People signing a contract before their land is registered need to understand they are taking a risk. Doing that is essentially taking the bet that the builder price increase will be higher than the potential fixed-price contract cost increase (0.5% per month) should delays occur. I am that situation right now although for another reason. My contract has expired because some neighbours have raised objections to my DA so it is taking much longer in council. Sydney 26Dec 03, 2010 10:07 pm It's entirely reasonable that they slug you a penalty for going over. You said you signed the contract in April and that price is locked in til February... that's actually quite good. Many builders only lock in for 4 or 5 months then start penalizing. Everything will have gone up in the almost 12 months since you signed, so it's perfectly reasonable that there is added costs. Hope your land settles soon... ours took 18 months so I know how you are feeling. Oh and hi to cmhamilton, I'm in Wallan too, in Hidden Valley just across the highway from you. Sydney 27Dec 03, 2010 10:12 pm Hi newlywed, We are also building the Milano 30 at Georges Fair in Sydney. We feel in love with as soon as we walked in and even though we went to every display home in Sydney nothing compared to it for us! We also have a corner block. We have converted the rumpus into an outdoor room & extended the side of the house as per the display in Sydney. As a requirement by GF we have to have a secondary facade, which I was happy with as I had planned to go with one anyway. M included a driveway in our prelim tender but when I told my dad the price (he is a builder) he nearly feel over. He has a contact who will do it for a quarter of the price. There a few other things we r doing after handover as we have friends in different trades to help out. We were originally told our land wouldn't have rego till Feb so I made sure M extended the build start date as I was sure we wouldn't start till March. Luckily was registered 4 months early so we are hoping to start building at the end of Feb! Good Luck with everything & I can't wait to see how your home turns out! M have been fantastic... no real horror stories here, thank God! Plus it was only a 22 week build and we had loads of upgraded inclusions... so pretty happy with that. With the penalty rates... see if you can lock in a price to extend the price until the date of registration - that's what we did. Sydney 29Dec 05, 2010 5:03 pm thanks for all the replies guys.... well paying the penalty works out alot cheaper than what we would of had to of payed metricon for the price hike on their homes... So all in all we do end up coming out on top....hopefully the land should be registered in feb so we wont have to pay too much.. It's great to hear that the build of these homes has gone smoothly... and yes i'm sure we could get someone to do the driveway for a hell of alot cheaper than what m quotes =) Question what is a secondary facade?? We have gone for the coastal as per the display home although we won't have the cladding but rather we will be rendering part of the front. Re: Building the Milano 30 from Metricon. Sydney 32Dec 06, 2010 9:22 am A secondary façade is the side façade of the house facing the secondary street boundary on a corner block. Most project homes have bland (e.g. straight wall) façades on the sides. If you are in a corner block it is usually required, by the council or the estate developer, to have a façade that looks nice both on the front and side facing the streets. Obviously a secondary façade comes at extra cost. There might be some other restrictions applying to corner blocks. For instance you may not be allowed to have service door or window (e.g. a laundry or bathroom) facing the secondary street. Sydney 34Dec 07, 2010 9:57 am well just got a DECLINED from the developer, LAKEWOOD! Here is the list of things i need to change; • Show path to front porch both in site and landscape plans M3tr1con are looking after this • Eaves are required to habitable rooms but as the windows are highlight window we will endorse Nothing needs to be changed here • Council requires landscape plans to be prepared by qualified landscape designer/architect I did the first one, was pretty bloody detailed but nope. So need to get it done by someone qualified. • Black or near black colours are not endorsed Now this sucks, at first i thought we would have to change our roof tiles and gutters (roof tiles are a coal colour and gutters are in monument) but they are ok. So i need to change the window trim colour - we had picked black and also the small rendering section which we had also chosen a colour close to black. • Fencing and side return fence, path, letter box as per attached drawing Both myself and M3tr1con had no idea what they ment considering there was no drawing to refer to? So we are chasing this up • Garage door to match selected face brick to mitigate garage dominance This one really pisses me off, we had chosen a dark colour bond wood look to match the colour of our front door. But they are telling us to make the garage door look less prominant we need to have it in a similar colour to the bricks! I will be calling them about this one as i believe the colour of the garage door does not dominate the rest of the house! So im not very happy, i mean there are some ugly colour schemes with houses already built in Lakewood so i have no idea how they got approval... I mean im paying to have a house built, big money. Yet, i cant even choose the colours of my own house. Fair enough if i was choosing fluro green and yellow but the colours i picked are all neutral colours that match.. I mean to have the garage in a similar colour to the bricks just kills the look in my opinion..
