Browse Forums Building A New House 1 Nov 30, 2010 7:37 pm Hi everyone Just wondering if anyone else has been in the situation where the footpath surrounding their lot has been damaged during their build? If so, did you have to pay for new concrete to be laid... or did your builders pay - either out of their own pocket or via an insurance policy for the build? Our council has today told me that we need to replace the broken footpath... which, quite clearly, has been damaged during our build. I've already put the situation to my builder, but are yet to receive a reply. I am wondering if anyone else has been in a similar situation, and if so, how was it rectified? Thanks very much, prov1xno1 - but, unfortunately, the developer has moved on, as it's not a new estate. Hopefully someone else out there might have some words of advice...? At the end of the day, it'll get fixed... I just want to see if there's any precedent for the resolution to not come from out of my pocket! Hmmm... interesting. I'm not aware of my builder having contacted the council earlier about the state of the footpath... but, that's not to say they didn't. Re: Footpath damaged by builders 6Dec 01, 2010 10:30 am With us (owner builders), we were sent a letter from the Council that we had to sign saying that we accept responsibility of damage during our build and it listed prices to be paid if certain things needed to be done (along with an initial fee to sign the form?!) He said that it is rare they have to use it, and it generally gets given back to us, but it is to cover there ***. Our neighbours trucks went over our footpath and have destroyed it in places. We have photo's of their pallets of bricks and the tracks going straight to them, don't know if it will be enough though. Maroondah council(Victoria) charges $200 for the permit and requires a $1000 bond before approval is given. http://www.maroondah.vic.gov.au/AssetProtection.aspx "If" something is damaged they will use part/all of the $1000 bond to carry out repairs if you fail to complete the required repairs yourself. My understanding is that by signing the application you accept responsibility for all damage caused by the people you hired to carry out the job. The local council will come after the person/s who applied for the permit regardless of who caused the actual damage.
