Browse Forums Building A New House 1 Nov 01, 2010 6:24 pm We had our PCI on the 20th October and are still waiting for the handover of keys. The bank came to the party really early and we have had a bank check for the builder since the 22nd however they haven't fixed everything that we picked up at our PCI. We have decided not to handover the check until all of the problems have been addressed. The problem was that our SS went on holidays (without telling us for how long) a few days after our PCI. He did organise for everything to get done asap but we are still waiting on numerous things to get fixed including major maitenence on our roof tiles. We have contacted the construction manager and he will be inspecting the house tomorrow but we were just wondering what our rights are. Is there a maximum time that the builder can take to fix everything? If they go over this time what can we do about this? We are in desperate need of getting our keys as we need to paint the internal walls of the house before the flooring is installed on the 15th November. Would you pay the builder and get the keys and allow them to fix things up after handover or would you stand your ground and require everything to be fixed first. We are worried they will take the money and not worry about fixing things until the end of the maintenance period which would be ok for somethings but we are especially worried about the roof tile maintenance. Our private building inspector found that water could currently get into the house (which has happened during construction) with the tiles in the current condition. Sorry for the long winded explanation. Just worried we will be left with a leaky house! As far as I know there's nothing you can do unless the builder exceeds the build time specified in the contract (after which they have to pay liquidated damages). To answer your second question I wouldn't be handing over that final payment until everything is completed but it depends how desparate you are to get into the house. Just remember that a builder that is taking so long to fix the PCI items is hardly going to finish all works with no incentive. We were always under the impression that the builder had 10 working days from PCI to get everything fixed. Our SS took a long time to organise our PCI cause he wanted to make sure that everything was finished but it has just taken forever to fix little things that should of been done in a couple of days. It didn't help that he has gone on holidays. We are waiting to hear back from the construction manager today. Hopefully he has some good news for us and I hope you get your keys soon too.
