Browse Forums Building A New House Re: Builder damaged council footpaths, are they responsible? 2Sep 22, 2010 1:44 pm I'm not sure if all councils are the same, but our builder completed an Asset Protection permit to our council. Under this permit I believe that council is supposed to check the site before building has started and when completed and if a builder/ contractor has caused damage they must repair it- if council has to repair it they will charge whoever they deem responsible. This is the info I have. Application of the principle Owners, council officers and builders may monitor the condition of infrastructure throughout the building process and record any damage which has resulted from building work. If suppliers or contractors have caused infrastructure damage, builders should inform them of their responsibility to conduct and/or meet the cost of repair works. Where contractors and suppliers have not repaired damaged infrastructure, builders should conduct repair works and recover costs from the contractors or suppliers who have caused the damage. Where owners, builders, contractors or suppliers have not repaired damage they have caused, councils may repair the damage and where the people responsible for the damage are known, they should be charged for the cost of repair works. I don't recall getting an asset protection permit from the council, I was only asked to provide photographic evidence before construction.
