Browse Forums Building A New House 1 Nov 13, 2007 11:18 pm We are building on a block wherey by the lot behind us (call it Lot X) is about 1.5m higher than ours. A retaining wall separates us both (as per normal).
We noticed some weeks ago that vertical and horizontal cracking appeared along the retaining wall in lengths of up to 2m. Also one of the large blocks making up the wall had moved forward (separated). This had all happened following preparation of Lot X. We queried the land developer, and on sending out the developer manager confirmed it was as a result of 'raking' being undertaken on Lot X. They (land developer) then mentioned that it would be up to us to chase up the owner of Lot X to action their builder in repairing the wall. Now I can see this developing into one of those 'issues' only resolved by taking someone to court. We don't know if we are overreacting, however the prospect of somebodies house ending up in our small (3m) backyard terrifies us. We have initiated contact with the owner explaining the situation and requesting action/acknowledgement with a copy being sent to their builder. We had contacted their builder some weeks ago indicating our intentions to which their reply was "We'll look into it" and (surprise, surprise) haven't heard anything since. It's your right to protect the integrity of your property, and if their work damaged your wall, it's up to them to repair it.
