We're building our new house and stombled onto this forum. My family's building a house in Mt Waverley and we're going with NBG. We're at the stage now where we're required to apply for dispensation becuase our house is over 6m in height(6.5m to be exact) on the East and our garage wall is over 3m in height. The garage is actaully on the boundary. We're also a slopey land (approx 5m from street level). I already have the application form, but we also have to provide "a written submission giving supporting reasons for the dispensation to be granted". I have no experience with writing letters and really don't know how too. Just wondering if others have had experiences with letters and if they can provide some pointers..?? Just want to use the right wording so I don't stuff up and delay the building process. Thanks. Re: Dispensation - Height 2Sep 12, 2010 5:04 pm dear sir madam, I am enclosing my paperwork to allow the consideration of dispensation for the build of our family home at........... the reason that we feel the council should agree to waiver the usual rules and regulations reguarding dispensation are...( maybe sloping block, size of block, energy rating needs....etc...you really need to have valid and real reason to get a dispensation ....) Re: Dispensation - Height 4Sep 13, 2010 1:32 pm Here's my letter that was written for a similar reason: Quote: Dear Municipal Building Surveyor Re: Consent and Report, Walls on Boundaries at room4acubby's house Following a review of the flood level for our single level dwelling to be built at room4acubby's house it has become necessary to raise our floor level by 600mm. This increases the height of the garage wall on the boundary at room4acubby's neighbours to an average of 3.59m and a maximum of 3.68m, which is above the requirements for Building Regulations 2006 – Sect 415 3 (a) and (b) which state an average height of 3m and a maximum height of 3.6m. We would like to ask for dispensation for this increased height as it is a direct result of having to comply with council’s flood level requirements. These flood level requirements were not included on any paper work or overlays associated with the property. The increased height of this wall will not affect any overshadowing of the neighbours to the North as it is to their South. Before demolition of the existing house on the block there were some very large Camphor laurel trees on this boundary that would have been higher and further forward than this new wall. The new wall is predominantly along the neighbours existing wall and ends just at the habitable window on their wall. Please find attached the following information to add to this request: • Application for Consent and Report. • Plans of the house prepared by our builder, please note sheet No 4 Elevation 4 for details of the wall in question. Sheet 1 includes the details of the adjoining property. • A signed copy of the drawings by the owner of room4acubby's neighbours indicating consent to the wall. • A recent copy of title. • Payment of $217.50. It is assumed that as this only effects the neighbours at room4acubby's neighbours who have offered their consent there will be no need to advertise. You should not have any problem with your paperwork the above letter is fine. Site Start: 10th September, 2010 PCI : Friday 27th January, 2011.
