Browse Forums Building A New House 1 Sep 10, 2010 12:28 am Hello, We had a PC sum for our kitchen of $33,000 that we went over on by about $2,700 - we spoke to the builder and also with the cabinet maker and they were both happy to let the cabinet maker invoice us directly thus avoiding the builder's margin on the additional costs. Now the cabinet maker is chasing his invoice to us but I have concerns about paying it as the work hasn't finished. The cabinet maker has our entire Miele kitchen in his possession and I am worried that if I pay his invoice that the builder could wash his hands if anything happens to the kitchen, at the moment the items missing are the oven, cooktop, micro wave, heating drawer, coffee machine and the benchtops. My concerns revolve around receiving my kitchen appliances scratched or if the benchtop has been cut to a wrong size and the cooktop doesn't fit. Basically what I am wondering is if anyone has tried something like this before, gone above the PC sum with or without the builder's preferred supplier for it only to go pearshaped and the builder then denies responsibility because you negotiated a deal and arranged everything with the supplier? Obviously I would also like to hear from people where the builder has taken responsibility for any problems incurred with the supplier (who is his preferred supplier) on "additional work". It's hard to define exactly what is the additional work - arguably it's not relating to the kitchen cabinets or the installation of the appliances but probably rather the vanities in the bathrooms... if that makes a difference. I would expect the builder to have responsibility only for things that you are paying the margin on. That's my totally un-legal opinion. Why should you pay for them before you received them? Re: Legal issues surrounding PC sum 6Sep 10, 2010 2:06 pm most builders don't put appliances in until the end of construction (in case they are stolen etc)..... from the other side of opinion (not necessarily mine) but I would pay the PC sum difference now, poor cabinet makers have spent the time making, installing, spending money on the supplied and for some trades (depends on if they are a big company etc) they are desperate for the money once the job is done. But I do agree, the main payment should be chased through the builder.
