Browse Forums Building A New House 1 Aug 31, 2010 11:55 am ANYONE PLEASE HELP: Just informed our M site supervisor we want to take an independant inspector through the house and he said that is not normal practise and that he is going to have to speak with his boss about that.... Can they stop us from taking our inspector through? Please ANYONE...freak out in progress!!! We have noticed MANY things wrong with the property hence why we need an independant inspector. ANYONE WHO HAS HAD AN INSPECTOR COME THROUGH THAT IS BUILDING WITH M PLEASE TELL ME!!! EDIT: CAN NOW CONFIRM AFTER SPEAKING WITH CONSUMER AFFAIRS THAT THEY CANNOT DO THIS: HOWEVER THE SS HAS SAID THEY DONT HAVE TO FIX EVERYTHING IN THE REPORT GENERATE BY OUR INDEPENDANT SUPERVISOR - CAN ANYONE SHED ANY LIGHT ON THIS? But it's absolute nonsense that this isn't a standard practice.. There are 100's of companies in Australia that do just that, PCI inspections.. If they come back to you and say no, I would be highly suspect about this and take it further. Also they can't really stop you from getting this guy into do the inspection, just leave a window or door open and let yourself in. The inspector has picked up a lot of problems, and has done about three or four inspections so far (they are not at PCI yet). They will have to fix anything that the independent building inspector picks up and that not within the building standards and tolerances. Your inspector will know what can be classed as a defect and what isn't and should only raise problems that they are obligated to fix. Some items such as a single tiny scratch in a window which is not major enough to be classed as a defect they are not obligated to fix. Easy way out of this is checking your contract. Your contract if a HIA Vic should hopefully read "You may bring someone along if you provide adequate notice to the builder". Which you have and therefore do not need to get permission even if it's an inspector. About the items that they will list, another reason why i said the SS was a moron. Yes you can have the items listed but you wouldn't do them afterwards via a report. What you do is you get the Inspector to give you all of the items and have them written down in the PCI list at the moment of the PCI before you sign. There is no reason why you wouldn't be allowed to. What you can tell the SS is this "If you have something to hide, you have time to fix it before my inspector comes along". I would make sure you are writing down the issues at the same time the inspector is otherwise you might have to wait for his/her report and it might be too late. But don't sign anything unless it lists all issues. And don't move in like we did with issues outstanding as they take time to come back and fix it all. Good luck and don't stress. I have now calmed down a little bit I have been reading the domestic building contracts act 1995 as was directed to that by conssumer affairs. Section 8 states that they have an implied warrnantee and if ANYONE can find defects in the property they are voiding their implied warrnantee and have to fix it. We have been advised that if we don't get anywhere verbally that we should proceed with a letter to the builder and from then go to Consumer Affairs. Our plan is this: Site inspector goes through the property alone, and makes his report. We meet him afterwards to discuss then he either provides us a list on the spot or we get back to the site supervisor with our list of things to fix and he fixes them. We totally understand that some things won't be classified as defects - and this has been explained by the independant inspector - who rates each issue. We will also walk through the property to make sure that all of our contract items are in there and in the right place - adding any inconsistancies to our list of demands that will need to be noted by the site supervisor prior to us signing off on the post construction inspection - is it then that we should get a date/time frame for when everything should be rectified? We will also provide a full copy of the report once it is recieved by the independant inspector to the site manager. Should I also take a copy of the act - highlighting the relevant sections and a letter of demand to show the SS we are serious if he isn't willing to fix our items? Can anyone see anything wrong with our above process? Can I also ask - what happens if we run out of time, can we ask to come back and say we aren't signing anything untill we do? The SS seems to think these things only take 20 mins...! I know our independant will be there for 1.5 hours! We honestly don't believe there will be that many BIG issues, and shouldnt end badly we are just not getting a good vibe now that we know he didnt want us to have it inspected...and is protecting himself saying they donthave to fix anything!! Will they require us to sign off on the PCI at the end? Or can we wait untill the report is written by the independant inspector, then provide M with a copy and sign that we are happy with the PCI and everything that we want fixed is listed? After you've done your PCI go home and thing about it. Unless they have a gun to your head, no one can force you to sign. What are they going to do if you walk off and say you'll get back to them once the indepand inspector gives you the report.
