However still waiting to get terms of this offer in writing as to what will be done prior to handover, what after, what won't be fixed and will compensate. Still waiting..... Seeking legal advice from lawyer tomorrow. Hi Michelle, Don't pay him half or any until they get the occupany permit for you and also install all applicances. That's when you can pay them full. In my case, I told them not to install appliciances because i want to do the concrete and floor first. Because if they put in the hot wall service at the side of the house, then the concreter cannot get to the back, therefore will be very hard. Same as dishwasher, because if it was in, I cannot install flooring, so it was best to leave everything, until I did my bits and then then they came back to install the rest, such as spa, water service, oven, microwave, etc. Good luck with yours. But I could pay half as long as they signed a document giving them a timeframe to return and fix defects and did not remove my contractual rights. I told them I could not pay anything until certificate of occupancy was issued as bank would not release any funds without that. No response from them and I don't believe I will ever see them again. Will cost them more than the final payment to complete house when you take the penalties into account. I have heard that the builders may be trying to go into voluntary liquidation. So just following up on everything. Their insurance policy that covers my home in the event of fire etc expires on Wednesday. So need to try and organise some insurance so I am not exposed to such a financial risk as with them having financial difficulties I doubt renewing the insurance is going to happen. Will have to wait and see what happens. Hopefully more will be known by the end of this week. I felt the same, as I didn't want to pay anything until an occupancy permit approved. The builder can get occupancy permit if the building pass structural works. Even though inside he may not have finish such as installing appliances. I went ahead and pay my Builder because I just want the keys to my house. Even though he have not deduct penalty for late completion in the final invoice, I paid him under protest and also noted that I don't want to remove my contractual rights. After handover, I found some defects here and there and I emailed the Builder. He did send someone out immediately to attend to those defects. It have been good. I was so afraid that he wont' come up if pay him. Can't help to feel that way. Next Thursday, I am meeting my builder, consumer affairs onsite to go through some of the defects that I lodged with the Building commission. Good luck in the rest of your building work.
