The build said they will come back and do it after hand over. Is it too risky to make final payment and just hope they come back, what would you do? Sounds like the go. Get them to put in a contract variation with all final points listed as post handover. That way they are still obliged under the contract to finish the work. If it's just exterior work, then I would probably do it, but if it's major interior work (re-tiling, re-plastering, re-painting etc) then I probably wouldn't, as that will inconvenience you a lot and you'd have to reorganise your furniture, cope with dust and mess etc once you've moved in. I have 1 outstanding issue still to get fixed 11 months down the track after handover....so I probably wouldn't handover any money until everything is fixed. That way, they don't get their money until it's done, otherwise you may be facing an uphill battle. I have mine in writing and they still have done nothing about it despite my phone calls reminding them. I'm seriously thinking of getting a quote done to fix the issue and sending it to them and getting them to send me a cheque for the amount. You need to think what is more important. So rather than just saying "no money till it's fixed you <INSERT DESIRED WORDS>", you would email daily if required a list of items to be fixed. Either way your contract stipulates what are your rights during final payment.
