My contract states: commencement must occur within 42 days after the builder receives: . the essential info from the Owner. . all necessary building permits and planning approvals . payment of deposit. My problem is our land settled on 4th June, 2010 and we have yet to get building permits (does anyone know if there is a timeframe for this part) and it is now 8 weeks and still counting, I'm wondering what is a reasonable amount of time, before I start jumping up and down. So far we have had 2 slab designs due to builder not furnishing Engineering Co. with compaction report. Now they send everything off to building surveyor for building permits and it has been knocked back as our porch is not within building envelope - and they advise they may now have to go to council to seek a planning permit for this (which apparently can take 30-60 days for the council to process). I dont know what to say or do at this stage and I have been very understanding with them thus far, but surely someone would have known about all the building envelope etc before now. any advise / feedback appreciated. Who are you building with? We built with Henley and didn't get involved in the permit or anything like that. Which estate are you building in? Some developers meet monthly to approve plans etc so that can cause delays. Re: Contract Question - where does it say they have to start 3Aug 09, 2010 3:04 pm Sorry forgot to mention, we are building in Green Gully Estate, it was just someone's huge property that was sold to a developer, who subdivided and sold blocks, there are no developers guidelines, it just has to conform to Rescode. There are 30 blocks in our estate and everyone has already commenced building except for us and about 2 or 3 others, some houses are even at lockup stage. She's had all sorts of issues with delays. Perhaps speak to council yourself and see if you can get any answers? We had our application with council for 10 weeks and hadn't heard anything back. When we asked the builder, they couldn't tell us anything. We called the council, and they advised that the builder hadn't subdivided the land or had approvals for the subdivision (they owned it) and they wouldn't look at our application until this occurred. By the time our land settled, we had all approvals and were ready to go. Our slab went down just under 4 weeks from land settlement.
