Browse Forums Building A New House 1 Aug 04, 2010 2:38 pm We are a week away from handover ... and moving in so were hoping to get the driveway and fencing done by then. Our builder PD Access has issues with it and would not allow this until the handover is done. They fear the contractor tradies may damage some of the building. I am sure on the contract with PD it was us the owners responsible for any damages and builder had nothing to worry about. For us we only have next week to move as we have given out our notice to vacate our rented property... Have any of you had troubles in this way and how did you deal with this? help much appreciated. He may be able to help you out. No other tradies or work to be carried out until after handover, covers them completely from liability for someone not under their direct control from damaging anything as well as the liability insurance. Good luck with it, but tbh I'm not sure you'll get too far. Fencing wise, well is your temp fencing already down? If so if the fence was to magically appear from your neighbours side, there isn't a whole lot they can do. However as you have given them possession of your land for the duration of the build they do have legal rights refuse admission to anyone onto the site. (Aside from yourselves for inspections but kinda getting off track). Check your contract, there is a clause in regards to possession and site access being the PD modified HIA contract. As for the driveway, its not really that neccesary to move in, not ideal but you could live without one for a few days. Re: Not allowed to bring in your contractors until handover? 7Aug 04, 2010 6:54 pm Driveway and fencing were done by our builder as part of package - however, as I have mentioned on here before, our builder was fine with other contractors comeing on site and agreed for external contractor to do aircon which was much easier and cheaper for us than haveing it done after handover. Must vary between different builders of course there are legal avenues. You've already mentioned it. Sue them.
