Browse Forums Building A New House 1 Aug 01, 2010 10:12 am Our home is well and truly on the way. Frame work is almost complete , the roof will begin this week. To our amazement the frame work was completed in a day. (we have taken photos) Before we demolished our crossover had a few fine cracks. When demolishing was complete our cracks on our crossover got a little worse. Construction is well and truly on the way our Crossover is destroyed. Not only have the cracks gotten bigger but the whole concrete has been ripped off by the trucks entering the property.. We have notified council and Henley a numerous of times but no one seems to take full responsibility. Henley has stated its our responsibility then its there's - a little confusing. Council has fixed it twice with bichamun (haven't spelt that one right?) bec we called concerned by passbyer's safety. They too have stated to look at contract who is responsible- none is giving us straight answers. Henley were suppose to place wood over the crossover but their not too keen on putting one of them on and in the mean time neighbors are complaining for safety reasons and trucks are getting bogged. Can anyone please help us who is responsible for the cross over and where can we find the wood plank that goes over the crossover? Has anyone else experienced this? Re: Crossover issues- Who is responsible? 2Aug 01, 2010 11:00 am We haven't started building yet but have been looking in to changing our crossover so have had lots of talks with both council and contractors. We have been advised to take photos of the existing footpaths and the existing crossover before construction starts so that we can prove that any damage that appears was done during building and is, therefore, the responsibility of the builder. Otherwise apparently we will be responsible for any damage. We are in the western suburbs of Melbourne. I don't know if all councils apply the same rules. We have taken photos of the crossover before any construction began. Council also visited the site before we demolished and after it was completed. We received our 1/2 of our bond back from council. Henley also visited the property before construction and sprayed with paint all the cracks that were already there. Everyone's passing the buck and no one is taking full responsibility. When is construction going to begin? Construction on site started on the 13th June and it looks like were at roof stage (frame). Things have gone up so quick!!!! I had driven passed one morning at 10.30am and the tradies were cutting the wood for the frame by 3.30 that avo the frame was up and they were gunning away.It was amazing! such an exciting feeling Re: Crossover issues- Who is responsible? 4Aug 01, 2010 11:38 am Im in perth and I had to put down a $2000 bond with the local council and the builder said that "they will take due care but cannot be held responsible for any damage incurred by the various trades". Fingers crossed they aren't a bunch of lunatics and I get my bond back! Re: Crossover issues- Who is responsible? 5Aug 01, 2010 11:39 am Hi Buildinganewhome, We don't have a builder as yet but it looks like you have done everything you could to prove that it is not your responsiblity. Did the same people do the demolition as the house construction? If the demolishers did the damage, do they have insurance that can cover the damage? I would just be going back to council and asking them for a clear answer as to who is responsible. Good luck! Re: Crossover issues- Who is responsible? 6Aug 02, 2010 11:39 am Spoke to council this morning and the SS and council has requested the crossover to be safe. the Builder is meant to be organising a wooden cross over and council will check on it. Thank goodness something has come out of it. Council has also informed us that there had been complaints by the locals about it.
