Browse Forums Building A New House 1 Jul 22, 2010 9:50 pm As part of our council approval process we requested a relaxation of our frontage setback from 6.0 to 4.5 metres. We have been advised today that our application has been refused. Our block is 20x35 metres, which is large block, but the shape of our house and our plans for a pool and shed (which were included on the drawings submitted to council as "proposed" works) means that this extra 1.5 metres at the back is pretty important to us to make our pool and shed plans happen. We can appeal and my question is, would it be worth it? Do these appeals usually bring about a changed decision? What are the costs involved? How stressful is the process? Or are we better to get over it, amend our backyard plans for our pool and shed and move forward? I know these things take time. The time thing does not concern us so much as we are in rush to get the place built. We are building in Moreton Bay Regional Shire Council (Queensland). I've read on the forum here about people applying for reduced setback because both their neighbours have reduced setback, on the grounds of fairness and consistency of appearance. But it doesn't sound like you have any compelling reason other than it being nice to have a large house and a big backyard. I think if you are in no rush then you would regret not appealling if this was an option open to you. talk to the council, find out what sort of things they take into consideration. are there any other houses in your street/area that are brought forward as much? make note of them in your application as they create a precedent. good luck with it, I know I would have been devastated had ours been rejected (though the building next to us is even more forward than us so we had a good case), and I would have fought tooth and nail before giving up my lovely big back yard!
