They've given us an estimate of late August for our fences. Which will be approx 3.5 months since we applied. Just wondering whether we're entitled to kick up a fuss about this and try get some action happening sooner??
Re: Delay with developers fencing & landscaping package 2Jul 05, 2010 7:34 pm I dont understand how your package works - but we did a house/land package where fencing was provided, we didnt have to apply for fencing, we had no choice in the fencing, whole development was done in 6ft high colourbond, cream colour ( I forget the exact colourbond name) and fencing was done before we moved in. Whole package took about 8 months actual building time, certainly didnt wait over 3 months just for fencing Landscaping (of front yard only) was also provided, Im fairly certain that gets done before handover too - not 100% sure though as we negotiated to have landscaping removed as we preferred to do it ourselves. All the fencing and landscaping was to be supplied by the developer (person/company we all bought our blocks from). Nothing at all to do with the builder. They told us to apply 3 weeks prior to handover, which we did. We assumed this was so they would be complete before we moved in! Really not happy as we've got little ones (2y/o & 3y/o) who've been cooped up inside for a month so far as they are bolters!! Not to mention we can't start our rear landscaping, we've had tradies drive all over our property to get to the other construction sites, our dining room window overlooks our neighbours master bedroom window (no privacy for them or us!), we are a semi-corner block so the kids playground, trampoline & cubby house is all in full view from the road. We've explained all this to the developer (or to his assistant or whatever!) but not getting anywhere. Hubby wants to seek legal advice, but not sure this warrants it?? We held up our end of the bargain by paying for our block, now they need to hold up their end and provide our fences/landscaping. Unless the restrictive covenants is what you mean? In which case, it lists a few terms & conditions (which we have met), and basically says to apply 3 weeks before completion of the dwelling. Hubby has been trying to get through to the director all week, but he has an answering service who won't just put you through to him - so frustrating! Leaving messages with them has proved pointless. We are STILL waiting for fences We have lodged a complaint with Consumer Protection (approx 6 weeks ago) and have sought legal advice (approx 3 weeks ago). Still no action from the developers as yet though! Anyone else been through this?? I have two littlies and keeping them inside 24/7 is now proving to be quite a battle with the weather warming up! It's been 6mths since we applied for our fencing and we still have no clue when it'll happen. We now have a court order for them to pay us the money for the fencing and landscaping, but like the contract, it basically means nothing to them. We simply didn't allow funds in our budget for something that was to be supplied by the developer :/ They are not a small developer, without giving away too much info, I'd say they are a large investor. We took our developer to court, It's been a long, slow process. We have a court order in place to be paid for the works to be completed. He's paid approx 75% off the court order. Which some was used to do our fences, just waiting on the last bit to complete our front landscaping. We're in the South West.
