Could you have any more bad luck?? There are standards that need to be adhered to for the composition and application of mortar. Definatley get it tested by an independant inspector. It also looks like they have not laid enough mortar as well. When the brick is placed in position the excess mortar should ooze out the side, this is then trowelled off. It looks like the joint has then been rolled but there was not enough mortar to get a decent finish.
I'd make them tear it down and get someone who knows what there doing. Also given that it has cracked so quickly there is every chance that any render applied would also crack. Good luck !!!
