This is what they said: This is POS under the ODP - known as Emerald Park. Two portions of land have been given up as part of subdivisions. The portion given up as part of Lot 4 Fairlie Road subdivision had the Condition removed for the development of the POS as part of the subdivisional works. Works on the other section of land was required by the developer as part of the Stage 5 Glenariff works (Taggart Development). There has been ongoing discussions between the City and the developer in regards to the works required in this location - the previous works (retaining wall, footpath, landscape works - were done without approval. There has been some recent works (last month) on this POS in terms of filling in of the basin - these works were done without plans being submitted and approved. I understand that a notice was sent to the developer from Planning Compliance and Luke Gibson (Manager Planning Implementation) has been involved. I am not sure of the status of this. The City does not currently have any plans or funds for the development of this POS. I think there was talk about including the development works in the DCP - Brian Saward may be able to provide more information on this. In the absence of any further works by the developers the construction of the park will need to be prioritorised against other capital works in the City. Although the plan and email refers to a pond it is not confirmed that this will be installed. This appears to be a conceptual advertising feature. There is no approved landscape plan for this park. ----------------------------------------------------- So.. looking at the above, I don't see the park happening for another year or two. And the pond probably not happening at all. Which is not good at all. Is this false advertising by Glenariff? I met with Taggart back in August. He stated then that the issue between him and the council was that he was required to give money to the council to develop the POS but the issue was there was no legislation in hand for the council to actually access this money from the trust account or whatever it was place in. This was supposed to have been sorted by mid October but looks like it hasn't. As for whether there is a lake or not I'm failry sure that the purchase agreements have a clause in them that any "representation" is purely conceptual and doesn't compel the developer or council to do anything. Peter Abetz, the local member, has been trying to mediate between council and the developer but with little success. Might be worth contacting him and getting his latest idea of what is going on. Basically from what I can gather the council and the developer are both at fault- the end resul;t being that those of us who've purchased blocks in the estate are going to have an outlook of dead trees and a bit of a sand pit for some time to come. The City of Gosnells finalized the Developers Contribution Plan just before Christmas, and it is now with the developers before the Council will formally ratify it, and then it goes to the Minister for Planning, and that will then allow funds to begin to flow for some of the issues that need to be addressed." So it now looks like the funds that the developer had already given to council for development of the POS have yet to be released but it's "in process". Interestingly enough in August when I met with Taggart he was of the belief that the funds would be released before Christmas. Our block is directly opposite the park (on Middle Parkway), so it will be nice to see something other than dirt and weeds. Looks like a class action against Taggagrt and Gosnell City Council the only way to force the issue. I just requested for another update on it. Previous updates haven't been positive (I got roughly the same response as you 2 months ago). I've just sent a slightly stronger worded email to him yesterday morning, and am waiting for a reply. While we do understand the issue, nothing's moving forward as far as I know.
