Browse Forums Building A New House 1 May 03, 2010 9:44 pm Today I have an intriguing mail from my CSO, no prior phone call. It's a post contract variation (PCV) form, requesting me to sign and return w/in 48 hours. On the PCV: 1-1 Delete "PROVISIONAL SUM" component ONLY from item 3-3 of contract. Note: item to remain. 1-2 Delete "PROVISIONAL SUM" component ONLY from item 3-4 of contract. Note: item to remain. Item 3-3 of contract: Provide drilling and pouring of concrete bored piers including Y12 reinforcement bar over. This item and related costs with bulk concrete will be confirmed or adjusted on receipt of Engineer's soil report and/or waffle pod concrete slab design. PROVISIONAL SUM. $3,800 PROVISIONAL Item 3-4 of contract: Provide concrete pump for bored piers (whole of dwelling). PROVISIONAL SUM. $950 PROVISIONAL Is my builder trying to be d 0 d g y and charge me the max. $3,800 & $950? On schedule 2 of my contract under provisional items, estimated bored piers at ~$2,850 & bored piers concrete ~$712.50. There is a % which builder can factor in case the estimation goes over. Now I don't see the need for me to sign a PCV to delete the wording "PROVISIONAL SUM" from 3-3 and 3-4 on my contract. Anyone has similar experience? What do you reckon? Re: Delete "PROVISIONAL SUM" component - raised as variation 2May 03, 2010 9:59 pm Any variation must be agreed & signed to by both sides. If you don't agree don't sign then you will be paying what is already agreed to which is the provisional sum which they must provide proof /reciepts. Question them what it is and ask them to explain. Only sign if you are happy. Re: Delete "PROVISIONAL SUM" component - raised as variation 3May 03, 2010 10:59 pm On the surface it would appear to me as if they are trying to lock in the amounts of $3,800 & $950. My understanding is that provisional items and other PCVs are normally settled as part of your final handover payment - that's the way my builder operates, anyway. I'd give your CSO a call or email and simply ask "So ... what's that PCV you sent me all about?" Built a Tribeca 44 with the Big M Sales Accept 15/06/09, Contract Signed 24/09/09, Site Start 23/11/09, Slab 11/12/09, Frame 12/01/10, Roof 20/01/10, Lock-up 30/03/10, Fixing 30/04/10, Handover 27/08/10. Re: Delete "PROVISIONAL SUM" component - raised as variation 4May 04, 2010 12:28 pm That's exactly my thoughts too. I've not signed the PCV form but sent a mail asking how and why this PCV came about. I have not heard back yet. I suspect builder is trying to recoup money from me because of my demand to relocate a consumer gas pipe out from my cupboard (need to rip out kitchen benchtop, cupboards and plasterboard). They agreed to do so without additional cost to me, albeit very unwillingly. You talk about deletions, are they variations or PS and PC adjustments? pleas list them 1 16557 I work with owner, he/she is my man on the ground and I instruct them when to visit the site and take photos and I have other tools in the bag. 4 15275 Looking for advice on whether this variation in tile colour is acceptable.
