Browse Forums Building A New House 1 Apr 29, 2010 8:08 pm Hi folks, I've been lurking on the forum for months and was looking forward to putting my build on which I still will when I'm feeling better. The issue I have is that I bought a block of land (in East suburb of Melbourne) before the titles were released and then found out that the allowable building envelope percentage is 45% of my 680m2 and the house that took months to design and is now absolutely perfect takes up 50.13%. That's a 35m2 overflow. I've looked at it time and again and there's nothing I want to change. I just don't. So I want to hear if anyone out there has gone to council for a planning permit to change their envelope side - especially if you won. I'm going to fight it but the council, verbally, said they would not be very amenable to any change on the title. So it's probably a trip to VCAT. I'm looking for any experiences from all you wonderful folks just to put this issue into perspective. My wife is so stressed by it. We opposed one in Qld, it was a long time ago (1996 I think). We had an acreage block that had high and low areas. The low areas had the building envelope due to possible flooding. But the envelope went through a high area too, which was where we wanted to site the house. We applied for it to be moved, someone came out and looked and passed it with no dramas. Buy another block where your dream house will fit without compromise. I have native vegetation issues with our local council which make our whole project seem insurmountable at the moment - so I may have a similar battle on my hands! I won't be selling our land though! True, but what price for the stress? the ill-feeling if not successful? having to compromise the dream house? Any covenants should had been made available at time of purchase, so it is not as if the buyer was uninformed or mislead. It must go with the job.. sorry, councils aren't my favourite people at the moment. I still struggle to understand how they can dictate how much of my land I'm allowed to use and even down to which plants I need to include in my back yard... Did I buy it or am I just leasing it ?? They told us what colour our roof was to be and pavers only on the drive way. They can go jump on the pavers too !!!!! That includes outdoor areas like porches and alfresco. I need 340m2.
