Browse Forums Building A New House 1 Apr 29, 2010 4:28 am there have been a few questions regarding ******* homes, we were to move into our new home last november 09 still to this date we havnt, there are a lot of things still to be fixed on the house, numerous emails and phone calls to ******* homes but still no time frame on when they will fix these problems. looks like a visit to vcat for us. very shody contractors that dont like to finish things they start, a lot of damage has been caused buy some of them and then no one want to fix the issue, the concreter even forgot to put our front path in, said they wernt on the plans, funny thing they were on our signed plans. i would never recomend to build with this mob, i could go into detail but i would be here for a long time. If one complains about a burger purchased at MacDonalds or McD's, which company would a reasonable person conclude this to be? If you know the answer to this then you should be concerned about any company name variants and associated comments you may be hiding behind. Furthermore, in Australia, even if you only state the facts, but the iteration of facts is damaging then you are at high risk of being threatened with a defamation suit. Re: brand new home 3Apr 29, 2010 9:06 pm While I can understand the sentiments regarding potential defamation, I would hope that a statement of facts, which have not been decorated with colorful or emotive language, would be something which could be posted without fear. If we get to the stage where you can be sued for "telling the truth, the whole truth, and nothing but the truth", we can be sure that we are all in big trouble. I don't see newspapers being sued for stating the truth (just stuff they can't substantiate), car magazines for a bad car review (or bad reviews for anything from any sort of magazine, as long as the reason for knocking the test subject was factual) and I haven't heard of Greece wanting to sue Standard and Poors for down grading their credit worthiness to "Junk" status. If a building company is has serious problems with their service or quality, and choose to ignore customer complaints by exerting the legal restrictions in unfair contracts, then other potential customers should be able to be made aware of this. just my 2c worth Re: brand new home 4Apr 30, 2010 11:17 am I guess maybe to protect yourself just don't use company names, people's names, etc. It's a crazy world we live in, and even speaking your mind can get you into trouble. If you want to vent your frustration on a public forum go right ahead, tell every detail, but just don't post any names. I'm sure who ever reads your post will wonder if it's the same builder they're building with, and probably PM you to ask. And if you can be sued for defamation when you're having a PRIVATE conversation with somebody, including an electronic one, then the world is REALLY screwed up. Re: brand new home 5May 05, 2010 6:47 am i will be going to vcat to rectify this situation, already have had legal advice, if any one is building around the fawkner, epping area and are not to sure about this builder, (not a very well known one) and you want to know more about my problem you can email me and i will be glad to give you some constuctive feedback regarding them. but i really think that the price i have pain for this house should justify that every thing should be in first class condition, not, broken,scratched,not painted corectly, water leaks, broken roof tiles, chipped wall tiles, cracks in two windows. kitchen sink scratched and has some thing spilt on it and left a mark that cant come out. and the list continues, all this and we were told it was ready for us to have a hand over. when the workmanship and finish is not up to building regulations i think people have the right to be told. Re: brand new home 6Jun 06, 2010 6:48 am June 6 2010 and we are still not im our house, this is nearly one and a half years from when they were going to start building, aparently this builder has been to vcat on more than a few occations. maybe we will be in our new house by xmas, just dont know what xmas. Re: brand new home 7Jun 07, 2010 7:18 pm When I went to BACV all they did was call the builder once. BACV have no official powers so it doesn't normally help much. It is still worth trying as if you end up in VCAT it help to demonstrate that you took the initiative to try and resolve the issues. More importantly, when you go to VCAT, you need to have a strong case against your builder and if you cannot sort things out, terminate the via the correct legal procedure.
