Hi my husband & I recently purchased our first block of land, It has only settled a few weeks ago and now we are finding a few unexpected issues We love the block but now quite concerned of some unexpected blowouts. The previous owner applied for material change of use, for when he cut the block now it appears that he was meant the retain the cut to get the councils approval for this 'material change of use'. We don't know where we stand now as we could be up for huge costs that we were not expecting, ( a huge 5 meter high wall x 28 meters long as the wall looks like solid rock we were not concerned about retaining it but now after a particular builder looked at our contour plan we were told it should of been done to get councils approval and they can't understand how he got away with it before selling. We even paid extra to have all extra searches done before purchasing and it we were not informed of this problem. As well as the wall being build we will be up for the material change of use fee's as well. We been told we may need to sue, arrh i'm not so keen to do that, anyone have any ideas.
Still trying to get my head around this all, I guess first step is to go to council.
