(iii) where a person purchases a property, which was taxable in the ownership of the vendor (seller) and is to be occupied as a principal place of residence, the purchaser may be refunded any proportionate land tax paid as part of settlement. To apply for a refund, you need to complete an Application for Refund of Land Tax Paid at Property Settlement Form. We settled on our land in July 08 but didn't move in until Sep 09. I put in a application for a refund for the amount paid on settlement because I thought we were entitled to it because it was to be our PPOR but it was rejected because we were not living there at all during that year. I was able to claim a full exemption for the 1 July 2009 to 30 June 2010 year though. When I informed them I was planning to reside in a house I was building on one of the blocks, the land tax was cancelled ( had to fill in some forms and prove i was building ) on 1 block and the other was below the threshhold for any kind of land tax, hence i paid nothing.
