Browse Forums Building A New House 1 Apr 20, 2010 10:10 am Hi everyone After much deliberation we have decided that we don't want to continue with our current builder. They are inflexible, they are **, and we feel they tricked us at the sales stage by telling us all the things we wanted to hear, but not following through on any of those promises. When we went to tender our final price was almost $20,000 more than what they originally said it would be. They knew our budget was stretched to the limit as it was, and they haven't done one thing to help us reduce this price. We have found a much smaller builder (who at the time we disregarded because this other company were offering what we thought was a better deal) who is honest, upfront and very flexible - and therefore they will work out more cost effective too - that we want to build with instead. So, I have sent an email to our CSC outlining that we not be continuing to the contract stage. We have NOT paid the tender deposit (thank god!) because for various reasons we didn't feel comfortable doing so. However we did sign the tender agreement, but only because our CSC said that it was just for head office, and didn't legally bind us to anything, and that we had to. Of course this was a verbal discussion and not in writing, so I have nothing to prove she said this. Have we been totally naive in believing her about this? Can they now hold us to this? I understand we will lose our initial $1000 deposit because that was used to pay for the soil test etc, but can this building company demand we pay for other costs incurred? I am really stressed out. I just want to get on with building our new house, but I feel like everything is in a bit of a mess at the moment Re: Pulling the plug at tender stage - what can we expect?? 2Apr 20, 2010 12:07 pm I'm not really sure where you're at - I went through a similar thing, paid a $1,000 holding deposit and then got to contract signing and found that it was $20K more than I expected and so I pulled out of the whole deal. I didn't actually sign anything. What I wanted to say though, is that if your builder has done a site survey make sure you get all the documentation/results from it (you've paid for it, it's yours!). Then you can give it to your new builder and you won't have to pay for it to be done all over again. I basically told the builder that they could either give me my $1,000 back, or my site survey results. P.
