I was told we couldn't have a certain size kitchen window "due to the configuration of the overhead cupboards". What on earth does that mean? After bugging them for a week or two I got a clear answer which said we could increase the window size if we chose another overhead cupboard configuration, and they actually told us what it was. If developer says "4 - 6 weeks unti land is registered", change the weeks to months and you will be closer. I was just saying to my husband the other night, that if anyone I knew was about to build a house the first thing I would warn them of was if the land is unregistered to be extremely wary of the developer's timelines. We signed up on our land in Aug 2009 and were told that it would be registered no later than Feb 2010. We are now in mid July and it was only registered a few days ago. That's $7000 in late site start fees we now owe to the builder. Our full approval/loan offer from the bank expired. We got an extension and that also expired. Then we had to re-apply all over again, and still waiting on the full approval now! And all of this because of the stupid land delays. And they lie!!! Many times I have spoken with the developer's agent(s) and they tell me one thing and then the next week they say they're still waiting on that one thing!? Eg. "The certificate of compliance is already at the titles office. We're now just waiting for the titles office to release the land." And then 10 days later they say "The titles office is still waiting for the certificate of compliance. As soon as they get it they can release the land!" And not just little things like that. In Feb the agent told our solicitor the land will title by the end of March. March came and went with no titles. Then our solicitor contacted the agent again and was told it would title within 4 weeks (ie. end of April). April came and went. Solicitor contacted agent again and was told 2-3 weeks (ie. mid-late May). May came and went. Anyway, I won't keep going on with it... you get the point! Lie after lie after lie. They even provided us with a letter for the SRO to assist in our application for an extension regarding the Boost payment (as you have to start construction within 26 weeks from signing the building contract to qualify for the Boost grant) and that letter was written on 5th April and stated "As at the time of writing we still do not have title release however we expect this to be forthcoming within the next 2-3 weeks." It was another 14 weeks before it actually titled. That's a BIG difference. So, in a nutshell, for anyone buying unregistered land, be VERY VERY careful. Make sure you have the funds to cover your builder's late fees and/or try negotiate those late fees prior to contract signing. You will never get your builder to agree to withdraw them from the contract altogether, but you can at least try and minimise them. Ie. Ask the builder to give you an extra 4 months for the price of 1 or something. I know of other people that have got their builders to agree to things like this. I just wish I had known about it when we signed our contracts. Thank you so much. This has been very helpful. We definitely wish to settle and get these people out of our life.
