We were shocked to see that that there are huge cracks in our crossover and the footpath in front of our block. We haven't actually started building yet as settlement on the land is not for another few weeks. Can someone please tell me who is responsible for fixing this please? Would it be the current owners or the council? I'm guessing this is soething we would want to get sorted prior to settlement. I don't even know who to call to report it. Please help! Help please!! 2Apr 04, 2010 7:38 pm I would say the council should be responsible, the importaint thing to do, would be to take photos one with the time date stamp, perhaps a copy of the recent newspaper in the photo would squash any council claims that it was done during building, email the phots throught to the council, but try to get them to fix if after you build IMO. Help please!! 3Apr 04, 2010 9:41 pm Agreed - definitely on the fixing after the build (it is likely to get damaged during the build process if it is fresh), and DEFINITELY on something other than just time/date stamp to prove that it is now - before you own it. I'd probably also inform whoever you are buying it through - be it a real estate agent, a land sales office, private seller, whatever. Is it a new estate? Is it possible that a builder nearby has used your driveway for access to another property? Can you track them down and ensure that the council and current owner of the land is aware of it? It is a new estate and the house to our left is currently under construction so it is likely that it was caused by them. There are also large tyre marks on the block. We are buying the block through an agent so I'll call them as well. The last thing I want is to be stuck with the cost to repair it when it has happened prior to us even owning the block! Help please!! 5Apr 04, 2010 10:00 pm Hi jenni9546, we brought land in botanic ridge and our cross over is the same all cracked... we rang the council and botanic ridge... they both said that unless you have proof of who done it.. there is nothing that they can do. the council and developer is not at fault and its on the owner to fix. it was most likely the builders next door, but the only wayt to fight it is in court and its not worth it. So you might have to go to the persons you are buying the block off, it will be there decision to fix or not. in the end its not much to fix it yourself. Help please!! 7Apr 05, 2010 1:26 pm We had about four cracks before settlement. Photos and a letter went to the council from the builder to say that they take no responsibilty for them. Really just to keep a record of them. Guarantee you that no-one will fix them. The Council sent me a letter regarding this which included a fee of about $190 and a bond of almost $800 for any damage done during construction. It was to be filled out stating any damage that is already there otherwise they asume it has happened during contruction. I contected my builder and they took care of it as there liable for any damage that is done. This is in a new estate. Re: Damage to crossover. We also have damage done to our cross-over but fortunately for us we are in stage one of a new estate and since there was only one house being built at the time it was easy to put blame on the builder next door. They have taken responsibility for the damage and waiting for our build to be completed before repair it. A word of advice, yes take photo's all the time even if they don't seem important at the time. If you see a site being scraped next to you or nearby, visit your block as often as possible because you will become the victim of 'Slackiestbuilder Dropanywhereus' and if you don't know where it came from and only think you do, you'll never get rid of the rubbish. In fact you'll find other builders adding to your pile. These words may not inspire confidence in your forth coming build but it comes with the territory believe me. Help please!! 11Apr 06, 2010 4:12 pm Well I went to the council today and they told me that it is the developers resposibility as the estate is yet to be passed over to the council. They sent the notice of damage through to their 'works' department and told me that the developer has paid a bond to the council and this would not be returned in full to them until all damage reported is repaired once building is complete. They assured me that it would eventually be fixed and it would not cost me a cent. I'm hoping this is correct...I guess time will tell. Fingers crossed.... Thanks everyone for your advice.
