The HIA contract I signed with the builder says that the builder will provide the connections to the Storm water. However in the last couple of weeks builder asked me to get the LPD information from the council and provide to them. I provided that. However I don't think this is my responsibility as the builder should get those details from the council. I have never seen any of my friends done that unless it's owner builder house. Next day I received an email from the buidler saying that their plumber can't find the LPD (Legal Point of Discharge) in side my land so that they won't be connecting it and I have to get it done on my own. When I ring up the council, the Engineer said that they have provided with the diagram to find the LPD and it's in the adjoining land and in the eastman. It's sitting just other side from the fense and any registered plumber can connect the storm water lines to it. Wall of my house is very close to the boundary where the LPD is and it's just 2.6 metres. I am not sure why builder is not directly contact the council to get the details if there is any problem there and go through me and get the officer from council to talk to them. Still the work is not going to be done. When they deliver the house there won't be any storm water connection. I have to get it connected later time. I am not sure whether the council issue occupancy permit without storm water connected. The builder has played this type of tricks few times before and charged more from me. This time also they might want to drag the work further based on some mistake from the council and charge me more for that work later. Should the council provide LPD in side each and every land? I thought they provide some common point for many lads and buidler connect that common pit. According to HIA contract I am always in the loosing side. I am now sick of building my first house as I am waiting for more than a year. 6 weeks already passed from delivery date on contracts. Still builder doesn't pay anything back as I have signed variations. I changed my soap holder in bath room 4 months before even they dug for the concrete base, still it adds 10 days more to the contract. Similarly for every small thing I changed well before they were even close to start construction, I have to wait for 10 days for each variation. If they feel they still can't finish. The builder ask me to sign another variation on something. For example there is nothing specifically metioned on if they provide any plasters under the stair case to cover that area. So they asked me to sign another variation and extend the time otherwise they will leave a hole. I think this why all my friends suggested not to go for a new house as builders are always tricky and we will never win. At least in this situation where they clearly violate the contract, do I have any way to go to any legal body. I don't want to go to a court. I am just looking for a place to complain and get the work done from them. I don't want to wait for another year paying big interests and rents. Your advice would be very helpful. Thanks.
