I am stressed beyond belief and I really dont know where to go ![]() We have been having issues with out moss rock retaining wall. There has been a lot of movement with the wall. When they did the wall they didnt do the wall deep enough so when they built the house, and went down a little bit, we needed to put a small retaining wall near the moss rock to retain a small amount of soil. So after three weekends it was nearly all done. They put two rows of the wall up just one more to go. After two days all nice and straight. Day three noticeable curve. Looked at it more, the bottom bit of the wall is wanting to come out. Above the retaining wall is a house and they put up a concrete retaining wall and thats now dipped. We called the developer and they came out quick smart. they are getting engineers etc I was speaking to a guy across the road and he told me that the developer never got approval with the rock wall. I called the council today and that is the case. Everyone elses rock wall got approved in the development plans EXCEPT ours..... Originally the guy up top was supposed to be down next to us..... Now the developer is going to fix it..... for the 2nd time. But thats the thing...... for the 2nd time. It seems to be we are going to have issues. Next question is, was it legal for them to sell the block of land to us knowing they didnt have approval through council? We are sooooo exhausted by this we just want to sell. But selling..... we cant because we have to disclose to potential buyers that there is no approval..... which the developer should have done the same to us????? Do you know if we have a case? To be honest I dont know what I want from it.... I suppose I want approval through council so we can sell this house and move on.... If it is rectified and the Council passes it, then you shouldn't have any issues when it comes to selling. Otherwise I would recommend speaking to a lawyer if you can't get any satisfaction from the developer who is responsible for the wall and lack of permit. Hates the land developers :( 916Aug 29, 2011 5:05 pm Hey Jessie, the fact that the developer has put up a retaining wall without the consent of the council would be a problem (assuming it is the type of wall that requires consent as not all wall heights if they are under a certain height require consent). What this means is that the Council should have disclosed that there was no consent to you which they havent. They will need to fix this problem then arrange for Council to retrospectively approve the wall. However, this doesnt fix the frustration for you. I would suggest that you ask them to fix your retaining at no cost given their issues have caused your wall damage. If they werent doing anything about the wall then you may have a cause of action against them. Its the retaining wall the guy out up thats causing the issues ![]() I must say Land SA have actually been great. Once the guy up top takes the retaining wall down and done again the Engineers want to come out while they are doing it to make sure it is correct and then we will contact the guy from Land SA. He is getting Exotic to take part of the wall down and they will cover that cost, when really the guy up top should be covering the cost of damages caused. Land SA guy couldnt give us an answer on when Exotic comes out and if they damage like grass and pavers who will cover that cost???? Basically we have one grand worth of grass and dripper system which will most likely need to be replaced..... we shall see The neighbours are away but we have the details of the retaining wall guy. We are waiting for the email from the Engineer report and then we will forward that to him. Hopefully they move quickly as we have a 10 month old dog that wants to be outside. He doesnt have it tough though..... he has all the house to himself ![]() Re: Jessica SA! I asked the Land SA guy re the approval and he told me that he will look into it and the Engineer said its not hard for it to be updated at council. However, everyone down our road with the bluestone retaining wall is having issues. Upon investigation they supposedly didnt get approvals for any of the bluestone retaining wall.
