In the 'Contract of sale' Quote: 15 Resale ________________________________________________________________________________________________________________ 15.1 Until Settlement, the Purchaser must not without the consent of the Vendor, sell, transfer, assign, mortgage or otherwise encumber or in any way other way deal with the land or any part thereof or the Purchaser's rights or interest in or under this Contract. 15.2 After Suttlement, and until the dwelling-hose and landscaping are complete the Purchaser must not without the consent of the Vendor resell or transfer the Property. If consent is given by the Vendor under Special Conditions 15.1 or 15.2, the Vendor may require conditions to be complied with, and the Purchaser must comply will all conditions of the consent which may include in relation to a sale or transfer a requirement for the Purchaser to first procure the execution of an Assumption Deed by the purchaser or transferee. Everyone should put the "and or nominee" on every property purchase. Just in case, it gives you a way out to on-sell before settlement. Nothing in the Williams Landing land sales contract can stop the purchaser exercising their right to 'nominate' a different name for the title to be put in upon settlement.
