We bought a block of land in Point Cook (Innisfail), recently our slab was finished, while there don't seem to be any activities yet on our neighbour's blocks.
I am aware that we have to build a fence at the boundary to our neighbours, as far as I am informed we have to share the costs 50/50 with each neighbour.
Today we received by mail a "Notice To Fence" from "xxx Investments P/L, T/A Jim's Fencing Werribee West" on behalf of their client "xxx Homes, Sunshine" stating that they are required to send us the fencing notice.
Although I personally don't care (or should I?) who is doing the fence I was a bit surprised to read that I have to sign an agreement within 1 month for a fence. At earliest convenience I shall sign a copy of this letter, authorise "Jim's Fencing" and pay a 50% deposit (24.8m, 1.8m HT colourbond fence - total cost for both parties 1664.08$).
At least they allow me to contact them if I should require any other then the suggested fence.
I always thought I would agree with my neighbour once the houses are (almost) ready, we would get 3 quotes and would then decide and contract somebody. Why did I receive this letter already now? Is it my obligation to take care of this already at a time when our neighbour even doesn't have his slab yet?
Or is there such a long waiting period for getting a fence done that I was contacted already now in this "rough manner" ("If you do not agree with me as to the construction and kind of fence, I will apply Pursuant to the Fences Act 1968 to a court of Petty Sessions...").
Not only that I don't see any sense in a fence now, I also believe it could be damaged during the building process of our and neighbour's house. Is it common practise to get informed in this way and so early?
I would appreciate any comments and advices.
