I'm newbie here. I have the same problem but don't know how to deal with FHOG extension due to 3 month delays with council land title release. Do I need to write a letter to State Revenue Office or its the builder who should provide the letter to SRO? Hope somebody can shed light into this matter. Thanks! Re: FHOG extension 4Mar 25, 2010 5:20 pm I believe it is up to you to apply for the extension. However you should be attaching a letter from your builder and developer stating the reasons for delays to support the application If you do a search I'm sure there are few threads about exactly this problem Building "DOMAYNE" through COMMODORE HOMES in Pearsall WA Slab down 15-01-2010 Handover 16-06-2010 viewtopic.php?f=31&t=29049 Re: FHOG extension 5Mar 25, 2010 7:52 pm TimmyDunlop If you're granted the extension then you'll be still able to get the amount you where entitled to at the time of signing your building contract. Agree with TimmyDunlop on this one. You will also need to apply to the OSR and inform them of your circumstances. They will only consider your application after construction has commenced and all paperwork has been provided. The attached blog has got a reply from the OSR in NSW for their extension request. http://douchfamilyhome.blogspot.com/ The OSR will look at each application on its merits. Hope that helps. You will need to include the reference (UIN#) number in your request for an extension as well as letters, correspondence outlining reasons for the delay and why it was beyond your control. You also need to show that at the time you signed the contract (had everything gone smoothly) that your slab could have been laid in the appropriate time frame. Re: FHOG extension 7Mar 25, 2010 8:46 pm Thanks a lot for all the advices. This is my first post and a lot of you have been very helpful. I will surely enjoy sharing information on this forum Re: FHOG extension 8May 03, 2010 7:23 pm Thank god someone has posted this! I received a letter today from the SRO that we are only eligible for $18k and not the $25k. I went straight into panic mode! So does this mean I just need to send a request for an extension and provide them with a letter from the land developer and our builders? Any help is much appreciated. Any help is much appreciated. FSIV If they are saying you are entitled to less than you think, I would query this with them. I previously emailed them asking about how to get an extension, they said I need to send them the following: - copy of building contract - the reasons for the delays - written evidence from the source of the delays - a detailed timeline of events from when contract signed (eg when finance approved, council approval received, land settlement etc) - and an anticipated date when the foundations will be laid We are currently going through this, however at this stage, our builder won't give us a letter as they claim they don't when their land is going to be subdivided, hence they don't know when land settlement will be, when council approval will be received, or when they will be able to start. Doesn't seem like they know much of anything. For the extension they requested a copy of the builders contract and all info detailing the reason for the delays - a timeline. My builder did all of this for me, but apparently normally they dont (my friend works for a builder and their company leaves it up to the client) Re: FHOG extension 11May 04, 2010 1:11 pm Hope this helps.... We would like to inform you that in order to receive full $32,000 First Home Owners Grant you need to apply for FHOG Boost extension. To receive the Boost, the construction should commence within 26 weeks of signing the building contract. If you have encountered delays, that were unforeseen and outside of your control you should apply for an extension. Applications for extension must include the following: 1. A letter from the applicant(s) requesting an extension stating the reason for the delay and providing the applicant(s) i. Full Name(s), ii. Purchase property address and iii. UIN (if known) 2. A copy of the signature page from the contract to build. 3. A letter from the relevant third party (eg: builder, developer, local council or private surveyor etc.) that clearly states the nature of the delays and the actual or anticipated dates foundations were/or are to be laid. Please note that clients have to apply for the extension themselves. Please ask your solicitor for help if need it. Please email the supporting documents directly to State Revenue Office fhogvic@sro.vic.gov.au Lara and Joshua http://pdheywood25.blogspot.com/ viewtopic.php?f=31&t=31186 16.03.10 Scrape 29.03.10 Slab 08.04.10 Frame 11.05.10 Lock Up 03.06.10 Fixing 24.08.10 Handover Re: FHOG extension 12May 04, 2010 9:39 pm Thanks guys! Re: FHOG extension 13May 04, 2010 10:10 pm From the Office of State Revenue. Thank you for your first Home benefits e-mail. The Chief Commissioner may allow an extension where the delay was caused by circumstances beyond the control of the parties. Each request will be considered on a case by case basis. A request for an extension to the commencement date will only be considered after: You have lodged your FHOG Application and Addendum forms, and After construction has commenced - if lodged with your financial institution, or After construction has been completed if lodged directly with OSR. Where the construction completion date stated in the contract is within 24 months of the contract date or if not stated, construction is completed within 24 months of the contract date, favourable consideration will be given. The following list (non-exhaustive) provides other factors that are likely to be considered favourably: 1. delays in the registration and release of a new subdivision of land 2. delays in obtaining council approvals 3. inclement weather, provided that disruption caused is substantial 4. industrial disputes 5. natural disasters 6. any specific project delays. All requests for an extension must be lodged directly with OSR. Requests should be in writing addressed to the Chief Commissioner and the following documents should be included in support of the request: 1. Letter from the applicant(s) requesting an extension stating: The reason for the delay Applicant/s full name/s A day time contact phone number Property address Your FHOG application number if you lodged your application through your financial institution. The FHOG application number is known as the UIN Number and will be available from them. Hope this information was helpful. Re: FHOG extension 15May 04, 2010 10:33 pm OMG I thought I was the only one, but I guess there are many of us on the same boat. I was also panic and freakout when CBA advised us that we only get 12K when we should have 26K. We wrote a letter, get Peets (Our developer) and Urbanedge (our builder) to write a letter stating that the delay were caused out of our control. I've emailed them a month ago and they still haven't replied. I called up today and told them my bank is not releasing payment as I'm running short due to the 14K boost and request them to look at my file urgently...one of the staff said she'll get them to look at it this week, so hopefully I hear from them soon and give you an update. you need the UIN when speaking to the SRO and you can obtain this from you bank if they did the application for you. Sorry not much help... Hanna Re: FHOG extension 16May 06, 2010 7:04 pm Hi all, I just received a letter from SRO stating that the commissioner has granted me an extension of time to commence construction. what a relief!!! However, to be eligible for this, I have to complete my construction within 24 months.... That's not a problem because we're at fixing stage at the moment. So happy.... Best of luck to all on the same boat Hanna Re: FHOG extension 17May 06, 2010 7:21 pm I'm waiting to hear back about the boost extension. Shouldn't be a problem i've been told. Plenty of people would be in the same boat with so many developers behind schedule. Re: FHOG extension 19May 06, 2010 7:52 pm We've got to apply for an extension as our 26 weeks is up in a few weeks. The problem we have is that our builder won't give us a letter for an extension because they claim they don't know when their land will be sub-divided, and when we will have council approval. Hopefully they can find something out soon, and give us the letter that we require. contract signed: Nov 09 Released to Construction: 23 Jul 10 Slab poured: 9 Aug 10 Frame completed: 30 Aug 10 Windows & Gutters: 7 Sep 10 Bricks: 15 - 23 Sep 10 Roof: 24 Sep 10 Gyprock: 20 Oct 10 Lockup: 25 Oct 10 Kitchen: 27 Oct 10 Tiling: 6 - 9 Nov 10 Painting: 17 Nov 10 Carpet: 30 Nov 10 PCI: 15 Dec 10 Handover: 17 Dec 10 https://forum.homeone.com.au/viewtopic.php?f=31&t=35943 Hi, We have a single story MacDonald Jones house, on a waffle pod slab with steel frame.
