On the day the excavation started I received a call stating we would require 74 concrete piers and there would be a variation for the additional cost. I had my solicitor read my fixed price tender and the builder does have the ability to change the tender if the site conditions had changed since the initial survey. I am eventually happy with this until a couple of days later when I contacted the developer just to inquire why they have put additional fill on our block. The developer (laurimar) stated that their fill is of the highest quality and compaction and provided me with a report on my property certify this to give to my builder. The fill was also noted on the land contract which the builder had been given eight months ago. They also said that there would never be a need for 74 concrete piers and a class H slab. Our block is flat with 20mm of fall, no rock and now the site costs are $17K. I gave the report to my builder to review but they came back and told me it is too late to change as excavation has started. My dispute is that they only gave me the variation on the day excavation started and therefore I was allowed no time. Does this sound reasonable? You may want to keep in mind that if you do have a dispute on your hands, It would be worthwhile having a lawyer.
