Browse Forums Building A New House 1 Mar 10, 2010 6:43 pm Hi there, I need a bit of help to fight a variation. Here goes. The site is demolished and ready for the builder to move in. I received a call from the builder today saying they need a variation for drop edge beams with a provisional sum of $3k. They said that this is normally included in the tender but for whatever reason was left out and as such we will have to pay for it Our site is only slightly sloped. Sorry can't quantify that right now. I'm thinking that they must of thought it would be ok without drop edge beams when they prepared the tender. But now they've realised it's required and want us to pay. I don't think this constitutes a variation. It's their oversight and they should wear it. Anyhoo, what do you guys think? Do I have a valid reason to reject this variation and what can I do if they become difficult? Cheers. Re: Variation for drop edge beam 2Mar 10, 2010 7:45 pm HI dehamsta, It will depend on whether you have a fixed price tender, or whether you have a site cost provision, which means that they can add to it as per the contract if they find anything else when it comes time to start building. The slope on our land was 0.8m from diagonal corner to corner, and we had to have two different sets of drop edge beams, one which was in the tender, and the other a variation in order to get our DA through council.
