Browse Forums Building A New House 1 Feb 25, 2010 9:50 am We originally had council deny permit due to the eaves being over the front setback. So the builder moved the house back to get approval. It's not a huge amount, but with a small backyard every little bit counts. Not that I'm too fussed, but what could be done to allow the eaves to go over? what course of action would one take? Life is; then you tell yourself a story. Re: Eaves - Council Permit 2Feb 25, 2010 10:09 am Because of eaves? Sounds so silly! And now you're making me worried about ours! I'll have to check when I get home! Have you rung the council?? Im guessing it would be something like getting your neighbours permission to have your eaves extend in to the front setback? Re: Eaves - Council Permit 3Feb 25, 2010 11:32 am My council doesn't count eaves towards setbacks. It did count them in the previous DCP. It makes sense not to count eaves as the Council should be encouraging eaves for energy conservation. Including them in the setbacks only encourages peopel to get rid of eaves. Demolition August 2009, Construction Started September 2009, Completed December 2010 Re: Eaves - Council Permit 4Feb 25, 2010 11:52 am When we did our council planning permit application we needed to put in a Miscellaneous consent to allow our eaves to be over the building envelope (just the eaves, not the actual house). Fortunately we were given dispensation to do this. So I guess you could have taken the council to VCAT to try to get the decision over-ruled (not 100% sure about that as we didn't have to go to that extreme) Re: Eaves - Council Permit 5Feb 25, 2010 12:32 pm Well I rang the Building Services department of the Whittlesea Council and was advised that to apply for approval to vary the building regulations, it would cost $217 and could take months. All for the sake of 600mm or whatever an eave is. Haven't got the time. Slab has to be down by end of March. Life is; then you tell yourself a story. Update from me! Couldn't find the trimmer - not sure if there isn't one simply because the eave is so narrow. Went ahead with the spring toggles and it all worked out… 7 5866 The two 15mm holes are obviously not compliant. The Dept of Fair Trading would love to see this one!
