Browse Forums Building A New House 1 Feb 24, 2010 6:38 pm Hi, all My builder submit the building consent report for us to the council! Our house backyard set back is 2.58 meters but normally council requirement is 5 meters and then builder said they need to submit this report to council for approval! But got refuse feedback from council today, because they do not allow us to do so! I looked at google map and found some of my neighbours' backyard setback is below 5 meters as well, why they can do that? Anyone can help me how get council to approve it? Being rejected by council twice myself, my suggestion is to work with the council to find out what is the maximum encroachment they would allow, then go back to the builder to adjust it. My guess is most council wouldn't allow more than 10%, so maybe 4-4.5 metres at least. Without sounding too generalising, I found that a lot of builders are not very familiar of council requirements and all they want is for you to sign the dotted line. With the google map information, could it be because the council guidelines were updated only recently? Re: Council Reject building permit! Any solution! 3Feb 24, 2010 7:36 pm Remember, different blocks might have different requirements as well, so I wouldn't go by what you see on Google. Granted the front and rear setbacks are probably going to be more uniform. Do you have any easements along the back of your block? That would also be a concern. Like Jas said, you will probably need to work with Council and see if they will allow you to encroach on the setback. Good luck. Re: Council Reject building permit! Any solution! 7Feb 24, 2010 9:33 pm I reckon all Councils are different... Holroyd were very inflexible with the setbacks... In my case the porch was allowed to encroach by a metre and it did. However, the definition of porch WAS NOT defined at all so I found out that if the porch had a balcony under a roof, it was considered to be an integral part of the building... So, had to modify the roof, replacing part above the balcony with a pergola... So, good we did not have to move the house.... On the other hand, the Council allowed us to extend the secondary Facade fence beyond the limit (we're a corner block) after the management company (Stockland) wrote them a letter of support... ... built a Promenade with Clarendon. viewtopic.php?f=31&t=25104 20-10-09 - excavation and piering completed ... 12-04-10 - Basins fixed. Yes, my land backyard got easement which is at left hand side corner and size is about 2x2 meters, that's the main reason why council reject my setback 2.58 meters! If I were you, I would ask for an appointment with the Planning guy and get the sales rep from the builder to join the meeting also. Ask the planning guy for suggestion with the plan instead of asking for specific allowance. This is what I did after 2 years of just working with the builder myself, hoping the builder would know what to do, but that didn't help. And I learned from my lessons after the second refusal. In the end, from a 6.5 metre setback restriction (only my block due to bush fire risks, other blocks are 3 metre), I was able to reduce it to 5 metre in most of the rear setback.
