Handover: 3rd February, 2011 Build Thread: viewtopic.php?f=31&t=37677 Re: Contract to be signed with Homebuyers Centre - Melb 4Feb 17, 2010 4:33 pm ring09 They seem to do things a bit different, we have recieved quotes etc from other builders and they seem to follow, do an initial quote with payment of deposit, wait for land title and then do site/soil testing, colour appointment, then contracts (which seems logical to me) so that all costs are pretty firm). These builders seem to want you to sign a contract and do all by variation after and of course pay your 5% deposit at contract signing. There's a lot of variation between builders as to how they do things. We were supposed to do our colour selections etc post-tender and any upgrades would have been variations but due to problems getting access for soil testing, we got to do our tender in two stages, so there were no surprises in our contract. ring09 I am getting a solicitor to go over it on Friday and I am not confident to just sign it and find out they hit me variation after variation. Another odd thing they do is get you give them an initial deposit of $1500 and sign a Pre Work Contract - from the date of this Pre Work Contract signing they start counting down 6 months and if your land has not titled and all paperwork/permits and site start by the time 6 months is up they hit you with a 5% of contract price variation for each month you are delayed. It's actually common to have price rises built in somehow. Ou contract stipulated that we had a set price, IF our site start was before X date. Thanks to developer delays, we copped an increase, but it was "only" $1000 - which we were OK with, since we were aware from the start that it was on the cards. Good call to get legal advice - make sure the solicitor explains everything to your satisfaction. Take notes! It's all a bit of a minefield....
