Browse Forums Building A New House 1 Feb 03, 2010 6:42 am 4-5 months after finalising everything through per-start I am now told that the benchtops for my kitchen are unavailable till next month and I have to change my selection. I told HomeStart (WA) that I didn't care about the wait as the whole kitchen decor is designed around the benchtops. I have been told that as the plumbers, electricians etc, are booked, if I delay to wait for my original choice then I'm up for additional costs as a penalty, is that right? Can they do that? Re: Should suplier delays cost me? 2Feb 03, 2010 6:50 am What does your contract say about delays and penalties? 'A bottle of wine contains more philosophy than all the books in the world.' I think the builder has to supply you what's in the contract and any delays are not your problem. I doubt there's a clause in the contract that goes somethigng along "if the builder doesn't order something early enough and check that it will be avaialble on time, then the owner must pay for the delay" Demolition August 2009, Construction Started September 2009, Completed December 2010 Re: Should suplier delays cost me? 4Feb 03, 2010 8:17 am Yeah, Casa is right. and you can just turn around and say do what you must as long as the house is built according to the signed contract. Then you can turn it around on the builder and say they're causing the delay by not ordering the supplies even though they have a timeline of when everything is being completed. Make them pay you the $250/w or so (what evers stated in your HIA contract) for delaying your build for not having the supplies. ---------------------------------------- Building the PD Lisbon 24 http://www.porterdavis.com.au/#homeviewer/lisbon/24 Blog of our progress. http://lisbon24.blogspot.com/ Homeone build thread https://forum.homeone.com.au/viewtopic.php?f=31&t=28665 Just to makea point about this, an approach that some people have found sucessful in negotiating these rises down, Is to provide some workings to the builder, specifying… 4 81667 In fairness nobody gave a crap about the ACCC and the gag clauses continued in the pro forma templates of a few other builders after the ACCC took on Wisdom, and more… 19 73284 While i was across this behavior's pre appointing my (the builders) surveyor, I did tell the builder i was aware what they were doing and while i disagreed with it, they… 13 14552 |
