I thought we would have to seek approval from our neighbours but we don't have to. (we are going to let them know beforehand though so that can build their garage to butt up with ours of they want) The only things we have to do is include a special firewall inbetween the bricks. I was just thinking about it from a future property value perspective and that the neighbours wall being so close to my house shouldn't affect the resell value of the house. And of course whether what he is doing is legal. Since its all legal won't worry about it too much now. Looking at his garage boundary wall the garage eaves are going to fall over my land. Technically I do own the space over my land too right ?? Also the gutter can not be the standard config and need to be flush sitting above the brick work. But it was because the council has a 3m height restriction and their wall is going to be 3,4m high or something like that. Their builder sent us their plans and a form to sign. The other house is on a corner and facing the other direction. I have no touching or common walls. My side garage still has a fireseal wall and the parapet wall side, only goes to 28c to meet the gutters and the roof line, which is the same height for the rest of the house. We are allowed to have garage walls on the boundary as long as they do not have a window (we moved out window to the back wall of garage instead of the side), house walls with windows must be at least 900mm from the boundary. Perhaps that's required in some situations due to soil type or slope, but it's certainly not the norm. Our garage and the neighbours' butt up against each other (I think there's 150mm setback to allow for a slight gutter overhang) and there's no underpinning. There are some variations from council to council, but Vic building regulations allow building to the boundary in most cases.
