Browse Forums Building A New House 1 Jan 26, 2010 7:59 pm ok - we are 10 months late getting into the house. we sold out house back in may because we were told by the site supervisor that we would be in in 3 weeks (naive I know). we were then promised by the owner (a very prominent builder in the trade) that we would be in for Christmas. we are still in the rental that was supposed to be for only 4 weeks and its 8 months later. this is the short story (the police have been involved as tradies broke in and cut roof trusses, there have been numerous ****-ups on their part, and we have compromised completely in order to try and get it over the line). what should i be asking on top of the measly liquidated damages for all the additional expenses and emotional trauma that this company has put me through and how should I approach it? am happy to name and shame the company once we are in the house and this is all settled. - trust me, I will be shouting it from the roof tops with the way that they have treated us (we are on site supervisor number 12 - that surely is a record!!!) Re: what shall i ask for and how? 2Jan 26, 2010 8:10 pm Just trying to keep up with the topics you're starting I'll post my response here... 12 site supervisors Yep, I believe that must be some sort of record! You probably dont want to say too much until you have settled... but where have you built? Sounds like you've gone through an awful time, I really hope you get the compensation you deserve by the sounds of the nightmare build you have had I'm sure there's plenty of knowledgable people here who will have some fabulous advice... Re: what shall i ask for and how? 3Jan 26, 2010 8:21 pm Sounds like a nightmare, I hope it gets better. You must be entitled to a free set of steak knives. Re: what shall i ask for and how? 4Jan 26, 2010 8:39 pm Unfortunately they are probably doing what they have to contract-wise, and it doesn't sound like you will get anything more out of them yourselves if they have mucked you around this much. If you want to take it further then I would be doing it via a lawyer. Built with Sw1tch H0mes >Build thread< House status 15/12: Gates and A/C finally installed! I would say you should get more than liquidated damages on the basis that liquidated damages are for over-runs, but not of this magnitude. Good luck. Demolition August 2009, Construction Started September 2009, Completed December 2010 Re: what shall i ask for and how? 6Jan 27, 2010 5:50 am yeah - gone a bit crazy this evening. spoke to a lawyer - she reckons i would have a good case for VCAT but it would cost about 10-15k and that costs arent awarded most of the time. sort of put me off really as cant really afford to waste 15k (although i really want to punish this builder!) I work with owner, he/she is my man on the ground and I instruct them when to visit the site and take photos and I have other tools in the bag. 4 15284 Ardo That is so funny!
