Our building company has installed timber that cannot be stained and says we must pick paint. As our house is near completion we are ou happy with this and them breaking our contract. We have said we want compensation for them breaking our contract without our informed consent. Whats a reasonable compensation to expect from them before we pick a paint colour? Builder saying this wood much better as wood that got stained warped and cracked. You know how when you ask for a change and they wound you with the price? ...and when they give you a measly sum as discount for deleting an item? Well this is where the circle turns. I would get a quote from a tradesman for how much it would be to replace the posts with the timber ones you wanted , to remove existing, replace with what you contracted and stain. I don't think they have much room for recourse although no doubt you'll have to force them to do anything (which is probably what they're hoping - that you'll think it is too hard and go away) Re: compensation help needed 7Jan 14, 2010 10:34 am too true everyone. Im not letting them get away with doing something out of the contract. We cant so they cant. To be honest im over the whole stain look but i hate paint in such a large amount. Get a few quotes for full replacement and that is the starting point in $$ terms for compensation discussions. Of course, whether or not you actually go ahead with the replacement is not the point. They rang today and we told them we would like them stack stoned. They said they would consider doing it for us but we'd have to sign a waiver that if they all fall off they are not responsible....
